Scope clearance ?

I'm looking closely at getting a Pentax Pioneer 3-9X40 to go on my dads .223 Handi.   It appears to have a pretty large ocular on it.  Would it have clearence problems with the hammer?

I understand this is a very similar scope to the Burris FF2.   I'd hate to get it and it not clear properly.  Anyone have any experience with this?

If you can mount the scope so the power ring is just behind the hammer, it'll work fine,  I have a Burris FFII 3-9x40 mounted in medium Burris Signature Zee rings on my 25-06 Ultra, works fine without modifying the hammer, but you can remove a little off the tip of the hammer spur above the extension and gain some clearance for lower rings, there are several methods of modifying the hammer in the FAQs, I've mounted scopes on H&Rs in extra low rings even.  ;)
