Marlin Warranty and Customer Service

I was the happy recipient of a Golden 39A for Christmas. 

Happy, that is, until I began to wipe down the firearm with a oiled rag and get a good look at it.  There were multiple scratches and gouges around the take-down screw, along the barrel, and magazine.  There were also dents and dings on the end of the muzzle; I asked them to re-crown it.  What really gets me is that this was sold to my wife as "New In Box".

So, I packed it up and sent it off to Marlin with a letter asking for all of this to be corrected.  My question is, has anyone ever had experience with Marlin in this area, and what is the likelihood of them standing behind their warranty and making my rifle "New In Box"?
I refuse to have a battle of wits with an unarmed person.

Maybe the place where you wife bought it dropped it or something along those lines to cause the damage. I worked at a sporting goods store before and have seen that happen before. I doubt that they would have left a gun go from the factory like that, but you never know. Either way hope you get it fixed without trouble.

A gun might change hands several times from factory to end retailer.  From the factory to a distributor......from that distributor to perhaps another distributor.....then to say a retail distribution center and then to the end store.   This could have happened at any point in the process and/or by one of half a dozen shipping companies.  My guess is Marlin will cover it under warranty and I'd sure be interested to know how it is handled.

Well, stay tuned...

UPS says that the gun is somewhere between here and North Haven, CT.  I'll post the discussions, results, and satisfaction here.
