Can a N.Y. resident handgun hunt in S.C.?
« on: January 02, 2008, 04:54:56 AM »
I'm a N.Y. State resident with a concealed carry permit. I am planning a hog hunt in S.C. and want to use only my handgun. I know I need to carry the handgun unloaded and locked in the trunk for the drive down but I can't find any info about how to carry the handgun while hunting in S.C.
Can a nonresident handgun hunt in S.C.?
A link to S.C. handgun hunting regulations would be helpful.
Thanks
Warren

Thanks for the reply.
The S.C. site that you listed did not clearly answer my question.
I did find the following on a conceal carry web site ;

"Generally, the carrying of pistols without a concealable weapons permit is a misdemeanor. S.C. Code Ann. §§ 16-23-20, 16-23-50, 16-23-460. However, a permit is not required for:

A licensed hunter or fisherman engaged in hunting or fishing or going to or from hunting or fishing while in a vehicle or on foot;"

So I guess I will be legal as long as I get the required hunting license.

Yes you can hunt with it but that is it. Here's the rules and reg. http://www.dnr.sc.gov/regs/pdf/rulesregs0708.pdf when is your hunt? Rules change during summer and you will need new licenses. I don't know if out of state hunters need the hunters safety course or not. Hog hunting is year round also. PM sent

There used to be a web site called packing.org that had all the different rules listed by state but it is not up and running anymore.  I thought that SC honored most other states CCW's.  Maybe someone know's a new link to that site?

Take a look here http://www.handgunlaw.us/

Woulld appear S.C. does not honor N.Y. permits if I'm reading right, but look for yourself to make sure.  Hope I'm wrong.

The NRA says the samething.  SC does not recognize NY permits.

Warren:  your best bet is to contact the South Carolina licensing authority directly.  You have already found conflicts in regulatory language that add to your confusion.  Language provides the State of South Carolina does not recognize NY carry permits while other language seems to indicate you could hunt there with a handgun.  Best check with the source directly and specifically with someone who can provide a definitive answer.

Many state laws are written specifically to address the residents of that particular state and while seeming to apply openly to others they often do not.

A couple of telephone calls will cost you a lot less than the loss of your firearms, possibly the vehicle you transported your firearm in, and the fines you might incur for violating both conservation and criminal laws.

I would check it out directly.  Good luck.  Mikey.

The most likely reason for SC not to recognize NY's CCW license is that NY does not recognize SC's.  There is a reciprocity issue involved most of the time.  I have hunted with handguns in several states (SC not being one) and Africa with no problem.

If you are going on a guided hunt or through an outfitter, contact him and ask your question.

The outfitter doesn't see any problems and from what I can tell everything will be okay, so if all goes well I will post some pic's when I get back.
If the situation was reversed, I know a S.C. resident would not be able to handgun hunt in N.Y.

I am new to handguns - just got my carry permit two years ago (also in NY), and I didn't realize a handgun could even be carried out of state - even if unloaded and in a truck. What about all the states you would be driving through?

As long as its unloaded and its not on him. I would go a step further and put a lock on it and put it in a case with all my gear.

Here is the Rule-Of-Thumb as I know it. Providing that you can legally possess a handgun at your point of departure AND your intended destination, you may take a handgun through other states which are on your travel route. However, state requirements vary. Normally, the handgun must be in a locked box, separate from the ammo, and not be in the passenger compartment. If you drive a car just put the locked box in the trunk. Now that so many people drive SUV's, it is impossible to adhere to this provision.

It is also my understanding that any state could still prosecute you for unlawful possession within their state but that there is Federal law that could be used in your defense. The best advise is to contact the State Police in each state that you would through and ask them how to LEGALLY transport a handgun through their state. The only problem is that when you call you normally get the "opinion" of that particular officer and you can't prove what you were told if you are ever confronted. Something in writing would be very helpful but you are unlikely to get it.

Reading all all of these posts makes me very glad I live in Florida.  Even a non-resident, without a permit can carry a pistol on their car if secured in a snapped holster and then in a box.  The box can be the glove compartment or a cigar box on the seat.  When I go north and through Maryland, somewhere in northern Virginia the pistol gets unloaded, to include the rounds in the magazine and goes in the trunk of the car, or if in my truck, in my baggage.  Makes me not ever want to visit New York if ownership of pistols is tied to a permit and rules exist to confuse my feeble mind about what is legal.

Yes you can. Just get the proper non-resident hunting license and find a place to hunt. Big deer here in SC. I have killed 21 this year/biggest a 244 lb 10 pointer/190 lb doe. Both with a taurus 6 1/2 inch 44 mag with a simmons 2x6.  40 yards and 25 yards. 240 grain JSP and 23.8 grain H110. If you cant find any land, e-mail me, I have  over 100 acres of pines and scrub oaks and a rifle range and always willing to let decent people hunt it.(not during the rut/oct-nov)..............

omcforever is correct in that as long as you have the right non-resident hunting license it shouldn't be a problem. Just do as the others have suggested and you should be just fine. My only question is what the concealed carry permit has to do with hunting since if you are hunting you won't have the weapon concealed?

Rut runs here in the upstate late Nov to Early Dec. Prerut is the last few weeks of Oct and the first two of Nov. Post Rut is the second week in Dec. I had some luck this season. I took a 10pt 190lbs.
