Concealed carry rules for NY

      I would have put this question in the CC forum, but this is state law specific...
        I have had my handgun permit since 1972, and Back then, open carry was mandatory. Times changed and they have gone to CC. I have not carried very often,
   mainly for hunting/plinking in the woods.
  By the news reports as of late, I may start carrying at least a "mouse gun". My question is, when carrying concealed is carrying loaded legal ? I know that even the question
  seems stupid, since without being loaded when needed..the gun is useless..but stupid laws have been passed before...
     
         If carrying loaded is legal, how about "cocked & locked" if the pistol design will permit it in safety ?

Im from N.Y. dutchess county had my carry as long as you,I always carry cocked& locked
with a semi auto,a six shooter always loaded,it is legal if it was't why carry at all

There is no law that prescribes how your legally licensed ccw sidearm is to be carried, except concealed.  The choice of loaded/unloaded/magazine in/out is yours.  If you have a hunting/target permit, the firearm and magazines (if its a semi-auto) must be carried unloaded in the vehicle and the ammo contained separately until you reach your destination.  This means no more loadin' up the magazines on the way to the range or the field, (unless, of course, it is a ccw handguns and then you can carry as you please - you have that licensed authority).

In the 70s, open (field) carry was mandatory for Hunting and Target permits and probably still is - those were not concealed carry permits.  Concealed carry permits mandated the firearm to be concealed (so as not to cause undue public concern). 

A choice to carry concealed without the proper permit could be very problematic in the wrong situation.  Best to be sure you are properly licensed.  Mikey.

In dutchess county N.Y. when you apply for a permit you only get a C.C.permit.
Don't know about other countys in N.Y. I'v been carrying for 35yrs with no problem
concealed or in the open.

Ironglow...I would contact your local County Pistol Permit Office to make sure that your permit allows concealed carry as it might be set up for hunting/target shooting and not concealed carry.  A simply phone call should do the trick.  You may have to endure an update but that should be relatively painless.  I may have to have my father go through this as he has had his permit for 40 years and never had an update and doesn't even own any handguns now.  But, if I want to take him shooting with me, he must have his permit handy.  His permit picture is from his early 20's...He's 64 now.  So, he has changed a little.

  I guess I have to visit the county seat ! I originally got my permit in Wyoming co. but now live in Cattaraugus co..and have been thinking of transferring it anyway.
  I haven't carried regularly in a long time..but a situation came about recently, with Buffalo police warning about members of a "central American based gang" possibly
  holding "initiations" there by staging rear end crashes..and robbing or shooting the other driver.
   I don't travel to the city any more than absolutely necessary, but sometimes I cannot avoid it, so I better be prepared !

A St Lawrence county CC Permit Holder can "legally" carry a pistol in a vehicle LOADED!
I believe that is state-wide, except NYC!

I'm not saying it's legal to shoot from a vehicle (it's not), but you can have the handgun loaded.

   I like your signature slogan..I've always believed that large caliber never made up for poor marksmanship...LOL
   
     If I do carry, the only thing i have right now is a cheap .380 (which I don't trust), a Model 941 Taurus .22 mag 4",
  and a Phoenix .22LR pocket pistol for deep cover..but if worse comes to worse, i can make a facial shot easily..up
   to 20 yards with either of those two "itty bitty" ones...

  They are not much; but much more effective than a "plea for mercy" to a drug-headed gang member !

I too live in Catt. county. You are perfectly legal to carry a loaded concealed firearm in any condition provided you have a pistol permit. You can also call Marga at the permit office instead of driving there. Or if your in the area  on April 12 or 13 she will be at the gun show at the Little Valley Fairgrounds. If you want more info on the show feel free to PM me. In my experience Catt. county has been more "liberal" with the carry laws. I have walked into stores after hunting or target shooting while carrying and have had my holster or gun accidentally show while reaching for something and a deputy happens to see it and the most I have ever been asked is "can I see your permit" usually it's more like what ya carrying? I know that not all the counties are like that. I do have a friend that lives in Niagara county and he and his brother were coming back from the range and stopped at a store to get a drink. Friends brother just pulled his T-shirt over his revolver and a local cop could make out the outline of it. Long story short it took him almost 2 years and a few thousand dollars worth of legal fees to get his guns back and record clean. Hope this helps you out.

In st law county it is nearly impossible to get  concealed carry permit anymore since we changed judges.  You get a home protection target only.  But since I have one I can carry loaded but it has to be concealed.  It varies from county to county.  Checking with your county office will give you all the answers.

If your permit allows concealed carry, you can carry in a vehicle while the gun is loaded as long as it is on your person and concealed I believe.  If the gun is not on your person, it must be locked up and unloaded.

Never allow your handgun to "print" through your clothing...Not just for the sheeple or for legal complications, but for anyone who might have an interest in removing that firearm from you by no legal means.

Don't even think about carrying in NYC unless you are one of the lucky few to get a NYC carry permit.  It is a sad state of affairs but it is the law in NYC as arcane as it may seem.

My 60's  permit simply does not state any restrictions.   I have always thought of this just that simple.  No mention made of "Conceal or how to be used.  I was listening to a local radio show and guest who was very well versed  in NYS gun licensing suggested that a gun owner with hunting & target restrictions have his restricted permit amended and to fill in the application "FOR ALL LAWFUL PURPOSES".

   Right on..we are about as far from NYC as is Morgantown, WV . We are a bit farther from "Gotham" than is Richmond, VA....glad about that !
