« on: July 20, 2009, 06:05:34 PM »
i went to court today about my little bout a walmart back in april..
all i can say is what was i thinking... that guy has me by 50 lbs an its muscle....
when i saw him i thought that man needs a little something slipped in his brain..
i just can t understand a man that can fight as well as he can...belittleing an elderly lady clerk an then picking a fight with an old smaller man.. it don t make any sense to me..
yall pray for me that i can forgive him..it don t feel good to hate,,an think other things about it,, that a christian can t afford to have in his mind..im serious,,i want to grow on past this,,best i can..slim

So how did the court session go? What did the judge or jury whichever have to say about your actions? Old farts are supposed to have learned a long time ago to give up fisticuffs.

Slim, I don't know what happened - don't need to.  You are obviously a Christian and struggling with one of tougher things that we all do - forgiveness.  God will be there for you and will forgive you.  We'll be praying for you.

no offence greybeard but i think mabe you might have gone thru this transition from able bodied working man to just old man..mabe a little longer ago than i did..
my trip down has been too fast for me to adjust... at 55 i was in some ways a better boxer, scrapper, than when young..i knew a lot of tricks to getting in position for a punch...also many other little things that kinda,,made up for the natural slowing of reflexes..thats not to say i was ever good enough in my opinion to be succesful as a pro..theres just a broad variance in talent,,as far a boxing goes...i should add here that im talking just scraps an fistcuffs thats just natural happen in working crews ,ive worked on... we  really didn t think it was such a big deal.. one won one lost,,probably still be friends later
life is about learning,,but for me its awful hard to stand there an watch some bully run an elderly lady down an laugh at her,,without saying something to the fella..some people were not raised like i was raised.. they let about anything happen around them..for me my favorite quote is[ ALL GOOD MEN HAVE TO DO IS NOTHING..for tyrants an bullies to own the day..]
so ive past the lesson ,,i know im not able to physically stop the bullys anymore..
with time ,,it had to happen..now i feel im truely growing closer to my father in a way that my physical strenth ,may have prevented in my younger days..to truely learn to forgive an hold no malice,, for those who would abuse or spitfully do you wrong.. this is the lesson im prayin to learn,,an what this post is about.. thanks ,,sorry for going long..yall have a good day..slim :)
ps as to the results ,,ive gotta go back the17 of august.. my attourney, took a day off,,without letting me know he was ...so i set there all day for nothing i guess... i may be a real poor choice of attourneys also..hes got 500 of my money tho an hes gonna earn it even if he gets up there an sceams giveim the chair judge ;D
greybeard you are absolutely right,,my big mistake was excepting his invite to settle it outside..
thats where the learning comes in..if i had not went outside to settle  with him it would have been a first for me
and i just didn t know how to not do it.. i think ive learned now.. its just foolish for me with both shoulders shot an under medication all the time..

I'm still wondering what happened.  Did the younger guy kick your butt?  If so, why is the law involved?  I must have missed something.

Should have just shot him if you were that situation and you didn't start the whole thing.  I'll shoot somebody before I'll take a butt woopin.....I carry, so I won't have to fight.  In the two situatiions in my life where I almost had to fight, they just passed me on by.  In short, if old and frail, carry a gun.

magooch .. walmart has good video coverage but no audio.. to them it looked like i followed him to his truck to antagonize him i guess...
what they didn t hear was his insults to the elderly lady and him sayin,to me,, well let me take my dog  an put it up ,,an we ll settle this..thats why i went outside withim...in my mind thats the only choice i had....hence the lesson i had to learn.. im not afraid to take a whipping ,,never have been...but i hadn t counted on getting charged with starting a fistfight with him...if walmart would ever turn the video loose ...they can slow dn the action when we came togather an see that i niether landed or tried to hit him ,,an he was grease lightening, landing 2 really hard karate strikes so the tape at regular speed is a blurr.. so i was charged with.. attacking him...sounds crazy i know but,im the only one that has to know thats the truth,,in the end anyway..
he may be aware enough of walmarts procedures to have planned it that way..
i don t know nor care.. walmart silenced the clerk,,after they allowed the police to charge me ...she won t even look at me now,,where as she was all thankful that day ,,an told her story... he was charged with bringing a dog to walmart i guess..
its been a learning thing that i had to go thru,,as part of just getting old an accepting the limitations it brings...i knew when i walked out withim that i was gonna probably get the worst of it.. hes got me by 50 lbs of muscle,,an now i know hes had good bit of martial arts training..
 hes 33 yrs old..
god loves him an all his children..he ll no doubt have a lesson for this fella ,,in this somewhere..
for me the lesson was that i can no longer stop bullys as i have most of my life..
thier my very worst type person,,an like as not id end up calling one out if they bullied some kid on the crew or what ever..thats one lesson..
but the biggest an hardest is finally learning to follow christ example,,in the face of this type person...
many here just can t relate to that last ...but some who believe christ set the real ground rules for successful living,,may understand.. im in a struggle to accomplish something that will amount to great personal growth... its these of faith that i ask the prayers from.. slim
ps one other thing fellas... i had my 38...but im not going to prison nor am i willing to kill a man
because he hasn t learned anymore than this fella has at 33 yrs old..i willingly entered into the confrontation...  my ccw is for muggers an those trying to harm me or family wiith deadly weapons an  such... i never ever thought about using it in a scrap..id just walk away first
which turns out i should have done anyway..

Best wished in this endeavor.  I've been there and know of the worry and problems associate with this type of incident.

I am 70 years old and have been packing for many years.  I still like to think I am in fairly good shape but I am also wise enough to know there are a lot of youngsters out there that can whip my butt.  As such, I would never invite someone outside, nor would I follow them out after a confrontation.  It has always been my opinion, “if it has to start, let it start here and we will work our way outside.”  Mere words can not provoke me to the point of doing bodily harm to anyone, if they are provoked to the point of doing me harm then they had best be prepared to meet their maker, I don’t fight anymore, it takes too long to heal up after an injury, but I WILL shoot if necessary. 8) 8) 8)

Slim, I sympathize with you; sometimes it is very hard to back down from a tussle, but usually it's the better course in the long run.  I often have to tell myself that it just isn't worth the upset and high blood pressure.  When some punk tries to provoke you, it is better to be prepared ahead of time to know how to ignor them, or act like you didn't hear them.

I purposely don't carry in some circumstances, because I'm still not sure what I might do if I let my temper get the best of me.  Particularly when I'm riding my bicycle.  There are some real jerks out there that think anyone on a bike is fair game.  On the other hand, I'm a pretty big guy and I'm in pretty good shape.  All the same, I've got nothing to prove to anyone, nor myself.

Walk softly, but carry a 357.

Fine to say but hardly appropriate in this situation. Had he then he'd be facing first degree murder charges. His mistake was going outside behind the guy.

Slim you are correct I likely learned it long before you perhaps due to age but for sure due to my work situation. I spent 30 years in federal civil service. There a fight most times got you fired no matter which of you started it you'd be lucky if both were not fired. Makes ya think hard when a fight can end your job and livlihood.

Your attorney can force the lady to appear and testify under oath and neither she nor Wal-Mart can prevent that. Just have him supeneao her. In many perhaps most states folks with that level of maritial arts training are legally responsible to use it only in self defense so him striking the first blow might have been illegal in that regard. I'd check it at any rate. Your attorney should know.

I'll pray for you.
By the way, I'm proud of you for at least trying to come to the defense of an older woman.
I think if you follow Graybeards' advice, this should come to a satisfactory end.
Walmart does not own the world, you can subpoena this lady.
Is this a trial by jury?
If so, if lady gives a statement that backs up your side of the story, you should come out OK.
GB is right about the martial arts practitioner as well.

Good Luck and Best Wishes

In addition, if this happens again, or if you are forced to defend yourself w/o a ccw,

One of my little mantras in situations like that is It Just Aint Worth It. There are few things really worth getting into a fight about. Another mantra I use is This Guy's An Amateur. I Get Paid To Deal With Much Bigger Jerks Than This Every Day.

Slim, from what I read your attitude sounds very appropriate for the situation. Keep on forgiving this guy, and when you pray for him remember that God will deal with him in the best way to try and straighten him out. Also remember all the grace, and mercy God has shown you all your life. Whatever happens God can turn this so something good can come out of it. Hang on.
