Hard to say what happened without the dash cam video. Howerever, in my mind, the existance, or not, of the sharp object is negligable. The fact that the officer was being drug was an asault on the officer and the vehicle a deadly weapon! As to the passenger being in jail, if he resisted arrest for any reason at all, he's right where he belongs. You simply don't resist arrest, for any reason. If you think you're wrongfully being arrested, and you have a funtional brain, you go along with it and talk to an attorney afterwards! Resisting arrest, tagged onto your charges, sure don't look good in front of a judge regardless of how inocent you are of any other charges.

In the absence of video, I have to withhold my judgment, but based on the article it was a good shoot.    Deadly force is justifiable in prevention of a forcible felony, such as assault on a peace officer with a deadly weapon, at least it is in Florida.  I would think other states give stautory justification as well.

Think about this for a moment. Do you honestly believe they told the dead mans family they lost the video? That never happened.
This same situation happens almost every time something like this takes place, the family demands to see the video and the answer in most cases is "We do not have the video at this time"
Which is true, it is evidence that is under investigation and has been seized by what ever investigative agency that does this type of work.
They will not release that video until the investigation is complete.
Somehow this always equates to the grieving family that the video is lost, grief and the violent loss of a loved one makes people unrealistically defensive .

If the incidents happened as they are claimed, then the officer was plainly justified. 

The dash cam video thing is a major eyebrow raiser though.  "Lost" can have many meanings.  There was an incident in the past where an officer brought a woman in handcuffed and sat her in a chair, and then (plain on the video) walked over to the camera and *turned it off*.  When it turned back on the woman was badly beaten and bleeding.  He said she was "resisting" and didn't have an explanation as to why he turned off the camera.

Just saying. Cops can do some sneaky things, and whenever I hear that the "tape is missing" I grow suspicious.  PARTICULARLY with so many jurisdictions trying to wiggle their way into making it illegal to tape police on the job (they don't like the scrutiny).

I'd imagine the tape will surface by trial time. It would be prejudicial to make it public. A 2,000 lb car is definitely a deadly weapon. If it all happened like the article  said, it was a good shoot. POWDERMAN.  :o :o

the Spokane cops are up to 4  very questionable shootings in a month latest was yesterday man had a obsidian knife and was running AWAY from the cop. Not threating anyone, local news is saying he was a felon (minor drug possession charge several years ago) But it puts the cop in a better light.

c'mon, we know why they camera was turned off - to avoid evidence, with full knowledge that such misbehavior will almost certainly be overlooked by his buddies in blue

Spirithawk and Powderman are right about the car being the weapon used to assault the officer. Therefore, deadly force is okay.
There is another case out there now that I saw on TV that is similar. A drunkin up and coming football player was pushed out of a bar at closing time. The cops told him to move his car from the fire lane he was parked in. In the process the guy hit two officers with his car and was out of control. The officers fired multiple rounds thru the windshield and killed the 20 something kid. It is said that it was a good shooting because the guy hit two officers with his car which amounts to assault with a deadly weapon. The kids blood alcohol level was 1.3. He was wasted and got himself killed.

In this case the police were wrong.
He was drunk and they should never had told him to get behind the wheel of the car.
He may have hit the two officers but they put themselves in harms way by telling him to move his car.
They should have had it moved by someone else, one of the officers, or had it towed.
They knew he was drunk.
He was only doing what they told him to do.
They knew better.
Their mistake hurt two of their own and cost a young man his life.
The shooting may have been a good shooting but the events that led to it were bad.
I bet if he had not hit the officers as soon as he stopped his car or drove off they would have arrested him for DUI, which would have been better than what took place.
Mistake on their part!!!

You are right Longtom. A cop telling a drunk to drive makes no sence. Unless they were going to let him move the car then get him for DUI.

I would ask why the trooper didn't just let go and back away then follow the guy ? In the heat of the moment he may have been trying to stop the guy from entering traffic . The dash cam if it was focous on the action may tell. We also didn't hear what the bad guy said or how hostile he was. Did the kid have hold of the cops arm or something ? lots of un ansewered ?'s
