Barrel stamp Error

Howdy , I have a Rossi pump take down model M-59 it is stamped 22 short , long or long rifle on the barrel , we had sent it to a repair shop because it would jam and not extract the shell  also it was splitting the case because the gun would chamber the shell and shoot,  the repair shop said is was the extractor but in fact we found out it is a 22 MAG , what course of action should I take with Rossi to get this gun fixed or replaced this is definitely a Rossi factory error

you paid for a 22lr and got a 22mag and you want that corrected????

Howdy ,so here is the rest of the story , I own a pawn shop and one of my employees took the gun in on pawn the person never came back so it was put up for sale , he sold the gun and the person he sold it to said it would only shoot once then jam , he gave him back his money and we sent it to a local gunsmith !  I wish I new it was a 22Mag before it went into the repair shop where the  gunsmith didn't figure it out until after he butchered some of the mechanism , this is a tube feed rifle and the model number is stamped under the barrel near the feeder slot of the tube , and the markings for the caliber are stamped on top near the sites .

Must be some gunsmith...As soon as I read "split the case and wouldn't extract", I was thinking .22 mag.  I would pretty much bet the farm that no manufacturer will make it right, now!

I bet the manf. will want it back to inspect. Did anyone check the bbl for size ? is the bore a 22 mag or 22 LR ? The first owner may have changed the chamber.
 But only inspection can tell this. No gun company wants a mistake out in public as it opens the door to law suits. I saw a Browning A bolt chambered and marked 3006 but had a 270 bbl. Browning wanted it back.
 Give Rossi a chance to do the right thing. The poor work by the smith dosen't change the fact they screwed up if they did.
