The burden of proof should be on the prosecution, which, unless you have a great deal of money is never the case. You must prove your innocence in today's court. (think duke la-cross team).

Lotta prosecutors out there that need to get Nifong'd...
Jesus said we should treat other as we'd want to be treated... and he didn't qualify that by their party affiliation, race, or even if they're of diff religion.

Unlike some, Jesus held no grudge against the military. It was obvious in the accounts where he dealt with the Roman military, specifically, centurions.
   In fact, he was very much impressed with some of them, particularly this one from Capernum whom he addressed;
''''''''''''''''''''''''''''''''''''''''''''''''''
When Jesus heard these things, he marvelled at him, and turned him about, and said unto the people that followed him, "I say unto you, I have not found so great faith, no, not in Israel". (Luke 7:9)
'''''''''''''''''''''''''''''''''''''''''''''''''''''''
Jesus dealt with other military, including one named Cornelius...and Jesus did not in any way correct or berate them for their occupation.
This info specifically for some here who are continually asking... "what would Jesus do"?
.

Of course he didn't....they were controlling his spirtiual adversaries. Pilate was also  impressed with Jesus, sorry he fell for the conspiracy in the end....

What about the % error in executions question...what % error is OK by you..??
.

..TM7
Exactly what do you mean in "error" in executions??  How many "innocent " men are in prison?  Again, if the general public could read ALL the evidence and details in each case you would probably feel different. I probably have become a very hard hearted man, being around convicted felons for 30+ years. Don't believe everything you see on TV or read.

Tennhilbilly;
You have already explained that you have worked around death row inmates for 25 years...

I just bet that if asked, 99 out of a hundred of the death row gang would say they "didn't do it".. ;)   :D   ;D

Supprisingly, some admit to their crime. Their lawyers argue that they are insane and therefore can not be exocuted. Most portray themselves as the "victim". They were there but the "other  guy" did it and turned states evidence on him, he was on drugs or alcohol and that wasn't his fault. He was beaten or mistreated as a child. The list goes on and on. They are the "victims" of their upbringing, addictions, mental illness, whatever spin you want to put on it to appeal the (I don't know any other way to put it) bleeding hearts.
Ever notice that not much attention is paid to the REAL victims in all this?  Mothers and Fathers burying their children,,,,Children that grow up without a mom or dad. Or don't get to grow up at all.  Not much of a news story there is there?

Sadly, the victims or their families and loved ones mean little or nothing compared to the poor misunderstood killers. Way too many murders are committed by formerly convicted murderers  put back on the streets by libby, unscrupulous judges and lawyers who see money as more important that right and wrong or justice. Correct PM. The liberals that are strongly opposed to the use of capitol punishment are likly also opposed to prison in general. They would open up the prisons and let these animals out to abuse the rest of us. They don;t care about victoms, they only care about criminals and most of this liberalisam comes from pandering to the minorities.

Capital punishment is a deterrent to murder.  The murderer is never going to do it again.

A lawyer told me many years ago that if a man had enough money, meaning paid him enough, that he could get a sodomy charge reduced to following too close, knowing that he was guilty. I said, doesn't right or wrong mean anything to you?? He said, right and wrong have nothing to do with LEGAL and the law or justice. I asked him if his conscience ever bothered him knowing he had put guilty people back on the street to do it all over again, he said no, not at all, I follow the law.  Now isn't that a fine example of a human being?? Way to many lawyers sell their soul to the almighty dollar. When they stand in front the Lord, they'll find out they can't change the verdict because of a technacality. gypsyman

That is the system though. A lawyers job is to get his client found not guilty period. A prosecutor does the opposite.

One thing that does bother me is the suppression of evidence. Let the jury see/hear all. The lawyer can then argue if it is germane to the case or not.

I definitely agree with that. Too much evidence is left out in a lot of cases that is essential. Present ALL of the evidence, let the lawyers cuss and discuss and let the jury decide. In a local case here they printed the entire trial of a man with a long record of dui, etc. His lawyer tried every dirty trick he could think of to suppress evidence that he knew was valid and pertinent to the case. Verdict was guilty, but I'd love to see that lawyer disbarred after the way he treated a lot of good, grieving folks. POWDERMAN.  :o :o

The Innocence Project does some righteous work; too bad more DAs aren't cooperative with them. THANK GOD for the Innocence Project:

Quote
AUSTIN, Texas (AP) — Texas prosecutors agreed Monday to release an Austin man who spent nearly 25 years in prison for beating his wife to death — but always maintained his innocence — after DNA tests showed another man was responsible.
District Judge Sid Harle recommended Michael Morton go free to the state Court of Criminal Appeals, which will make the final determination on overturning his conviction. Morton is set for release Tuesday afternoon or Wednesday morning, following a final hearing before Harle.
The case will likely raise more questions about John Bradley, district attorney for Williamson County north of Austin and once a Gov. Rick Perry appointee to head the Texas Forensic Science Commission. Bradley criticized the commission's investigation of the case of Cameron Todd Willingham, who was executed in 2004 after being convicted of arson in the deaths of his three children. Experts have since concluded that case's forensic science was faulty.
I wonder how many times some self-styled sage with a cliche rolled his eyes and said of Mr. Morton... 'yeah, I bet he says he didn't do!' We can be moderately confident they're not lining up to offer mea culpas.
I am further convinced that the death penalty is not a good idea, and again... I don't see Jesus pulling the switch.

Actually; I refer to it as the "legal" system also...and for the same reasons. I have seen some terrible miscarriages of justice..most often in divorces and where it is poor vs rich.
The legal system is far from pristine..but then, so is fallen man.  We cannot expect mankind to be perfect, so do we just turn killers, murderers, rapists and child molesters loose..to 'have at it again'?  That sounds too much like socialist Europe for my liking...

First off tennhiilbilly, I'm not exactly opposed to capital punishment in many iron glad cases, or in theory. But for example, the Barry Scheck group has gotten over 100 death roll inmate's sentences commuted or vacated, mostly based on DNA science...this means the perps that did the alleged crimes got off Scot free. I use to play golf with a DA who once told me that probably 10% of the people in prison are likely innocent and had poor representation, or made a deal....also said 10% may be light, but likely the accused did some other crimes that justified their imprisonment anyway.. ???
Rickie Perry presided over 234 executions in Texas, yet we are told that capitale punishment is a deterent to murder. ??? .. ::) ::) . So I, and others, now see some error in the process....enough to re-think capital punishment policies.  Of course, this doesn't affect the Rickie Perrys of the world, but others see a problem in the whole process...enough to say, "wait a minute, let's take a closer look."

Since, nobody will step up and answer my simple question--but I will....0% error is acceptable in Cap punishment cases, imo.

..TM7
"the Barry Scheck group has gotten over 100 death roll inmate's sentences commuted or vacated,".  I wonder how many were commuted and how many were vacated?  Two different things. Commuted does not mean the convict was NOT guilty.
The thing a lot of people don't think about is their tax dollars put people in prison and on death row and their tax dollars are used to get people out of prison, or off death row.  Taxes pay the DAs ,Judges and defense attorneys (in most cases.) Taxes pay POST conviction attorneys to represnt convicts to get them off death row and sentences reduced after entering prison. MONEY ON BOTH ENDS.
Deterent ??  It does one for sure.  Do you think a man thinks about being put to death before he pulls the trigger? Nope, only after.
Is there a deterent for murder? It's not about being a deterent, it's about closure. Put yourself in a mother's-father's-child's shoes that had a loved one murdered...Could you sleep good at night knowing the murderer is recieving free meals-clothing-health care-dental care-haircuts-no electric bills-no water bills-no rent-room service AND CAN STILL SEE THE ONES THEY LOVE.
Rick Perry was doing what he was elected to do, and followed the law of the land. Laws put in place by elected officials. People you (if you live in Texas) put in office to make the laws. He was following the laws of the people.
We can't have it both ways. Innocent men in prison? probably. Innocent men exocuted? could be but I don't know of any. But it's a sword that cuts both ways. People DO get away with murder. What percent is acceptable for murders to walk free?  Your 10 %?????
If these high powered lawyers can't get a man off death row in 20 years in this day and age with DNA and other means at their disposal.....what does that say??   I say the bottom just fell out of your 10%.
If your gonna be stupid, you had better be tough.
