Dealing with dealers???

Just bought my first used gun from retail sporting goods store.  Not being familiar with standard store practices I need information on how to proceed with a used firearm sold with cartridge jamming issues.  Is it buyer beware or is store responsible for selling goods in functional condition?

If the seller doesn't act responsable. It's a little to late to beware.

   Not sure how your dealer would handle it but the 2 i deal with would take care of the problem.

MikeThat's the point Mike.  Is it irrresponsible for a dealer to sell damaged goods and not stand behind in your opinion?

Most stores will make things right, however they probably did not shoot it themselves, so  it's like a gun show. You look it over and if it it looks good you buy it. The gun may or may not function properly.

Thanks for asking;  I was going to wait to report back when I know for sure. I dropped the gun off this A:M.  Store clerk said he believes it will be covered under store 30 day warranty policy.  If it turns out different, I will report back.  Thanks for replys.  Rebal

   Alot of stores sell used firearms on an AS IS basis only.   Under the Uniform Commercial Code, if an item is sold AS IS, there are no warranties whatsoever and no remedies.   
 
   If a prominently posted sign in the stores says they are AS IS, or the tag on the gun, or the paperwork you signed, then you received no warranties and have no cause for complaint.
 
  The phrase must be printed or typed in a distinctive text, but most courts have held that all capital letters or darker letters are sufficient.

Just picked it up from dealer today but haven't tested it yet.  No charge.  Dealer said it only needed cleaning & polishing.  Thanks for all replys.

What kind of gun?  Some like less expensive pistols don't like anything except full jacket; Win 94's don't work well when chambered with .44 or .357 (wrong carrier design); old Remington pumps (don't remember model) were made for rimless, so don't feed .30-30 right.  Hope the cleaning was the answer.

It's a 1979 produced Marlin 336 in 30/30.  Since getting it back from dealer I have mounted scope on it and ran about 20 shells through it; 170 grain Rem soft points.  All is well.

   Keep in mind for the future most not ALL who get rid of gun, car, truck, X WIFE, their is usualy something  wrong or they would have kept it in the 1st. place, how many times right here have  read were someone posted at they couldnt get right so down the road it went for someone else to see what was wrong with it.   Jim

  Good point Jim;  Lucky for me that I bought used gun at retail dealer and not auction.  This begs me to ask,  What if I bought at auction/ pawn shop?  Do they warrant their merchandise to be free from malfunctions?

rebAl, not sure about pawn shops, but, I can tell you that if you bought it at an auction, it's yours no matter what. If you buy a gun at a gun show, depending if it's  licenced dealer or a private sale. Most of the time, if it's from a dealer, you can get trade in value for another gun. Depends on the dealer. If it's from a private individual set up at a show, your probably on your own. gypsyman

     Most pawn shops are not gunsmiths, we can look them over and clean them up, but we do that when we loan money on them, we dont shoot them or inspect them as far as just a general good look over, as any one that would be looking at them to buy, our goal is to loan money to make money we offer a service on that aspect only, if someone bought a gun from us we would work with them, however if it was brought back with something that was obvious that it happened after it was sold it is theirs to correct, always keep in mind when buying used why did that person part with it?  No matter who is selling it.   Jim

Years back I use to have a store.  When ever I took a rifle in trade or bought it out right.  I always checked it out to make sure the firearm didn't have a problem.  Majority of the used firearms I had that I had bought just needed a good cleaning.  One example I had a fellow sell me his Win pre 64 for $50.00 and he was going to Walmart to buy a different rifle.  He had said it always jammed on the 3rd round.  The only thing that was wrong with it needed a good cleaning.  Cleaned it ran a box of shells through it and never had a problem.  Resold the rifle for $350.00.  His loss my gain.
