Assuming this is a rimless cartridge there is nothing wrong with your ejector. I have a couple that will do the same thing. THe ejector is designed to drop out of the way when the gun opens, if it didn't it would intefere with the body of the brass. There is a small spring & button in the underlug the pushes the ejector into the notch on the rimless brass when the action is closed.
