The Breyer case was handled in the U.S. by the Justice Department's Office of Special Investigations. Eli Rosenbaum, who previously headed the office, would not comment on any details of evidence that had been collected against him, nor say whether American agencies were involved in helping with the German probe. Rosenbaum is now with the Justice Department's Human Rights and Special Prosecutions Section, into which the OSI was merged.
 
Breyer was born in 1925 in what was then Czechoslovakia to an ethnic German father and an American mother, Katharina, who was born in Philadelphia. Slovakia became a separate state in 1939 under the influence of Nazi Germany. In 1942, the Waffen SS embarked on a drive to recruit ethnic Germans there and Breyer joined at age 17. The fact he was a minor at the time was critical in the 2003 decision to allow him to stay in the United States.
Called up to duty in 1943, Breyer said he was shipped off the same day to Buchenwald -- in Germany -- where he was assigned to the Totenkopf.
 
By treaty, the U.S. can extradite its citizens to Germany. But Breyer said he would fight any attempts to take him away from the U.S. and his wife and family.
"I'm an American citizen, just as if I had been born here," he said in his Philadelphia home. "They can't deport me."

I don't know about any of you ex military enlisted guys. I never had a choice when or where I stood guard. Perhaps the SS was more accommodating.
 
As far as volunteering to join up. geez I remember "volunteering" to give blood while in basic training and having the privilege to give a rather large floor at the same day a real good cleaning,waxing and polishing look.
 
BTW. The Waffen SS took in Draftees at the later stage of WW II.

Isnt't it about time for these organizations to close or repurpose themselves? Simon Wiesenthal was right for what he did as a nazi hunter after the war, but for heaven sake, it's been 65 years and you have to be at least 85 to have even been in the war. Most kf those war criminals are long dead f natural causes.

I agree, it's been too long.  Any of them left were kids when they joined like this guy, and did not know what they were getting into.  Like BBF said they did not have a choice of where they were sent or stood guard.  Once you are in you do as told by others.  Anyone left alive will most likely not remember what the war was about for them anyway.  They are either in or ready for a nursing home.  After all these years what's the use, let it go. 

Better start planning for tomorrow.  Their homeland may just go away, or become uninhabitable real soon.

I stood over a couple of mass graves in Bosnia and stared down at the rotting corpses, there are some crimes that time should never assuage. If we chased down the people that committed these crimes when they were 110 years old it would still be justice.

Committing them or being in the position to order that is another thing than being a young soldier that stood guard supposedly outside the gates.
