Concealed Carry
« on: December 11, 2012, 04:07:26 PM »
http://news.yahoo.com/court-strikes-down-illinois-concealed-carry-ban-205728123.html

It looks like concealed carry might be in the future for Illinois.  Maybe things aren't quite as bad as they seem.

This Appeals Court Decision was good news, but I'm not jumping up & down yet.
They might Appeal or make it an extremely restrictive "May Issue" permit as some states have.  Lets hope they do the right thing.

Unfortunately, there's still ways for the elected criminals to make the ruling virtually ineffective. The phrase "reasonable limitations" is the one that worries me. Far too ambiguous.
Still, it's a step in the right direction and I'm happy for the people of IL. Your rights have been trampled long enough .

I, too am guardedly optimistic here. I think the main point here is that we now have a precedent that says concealed carry is a part of our right to defend ourselves. Had a concealed carry law been passed prior to this decision, something restrictive like a may-issue type permit may have flown. Now that this decision has been made, a may-issue permit may be construed as interfering with that right to self defense. That being said, I expect to see Quinn and Emanuel brainstorming to see how restrictive they can make the new law. I also see Madigan appealing this decision and dragging it out in court as long as possible. This is Illinois after all. Assuming this decision holds up in court, I think the outcome will be a shall-issue permit, with background checks and some kind of training involved. Maybe it's just wishful thinking, but I'm willing to wait and see how this plays out.

If the Chicago dems don't want to play fair, then the Republicans won't pass anything.  That, by default the way that I was told, would mean that there is no restrictions on CCW.  If you had a FOID card,  you were good-to-go.
If you do the research and look up Brandon Phelps (yes he is a Democrat but he authored the CCW bill last year), you can find the language of it.  The wording of that bill is "shall" not "may".  It also sets up all of the standards for training, etc. and there is no "home rule" allowed.
It is my understanding that this is the footprint of any legislation that will be passed...put it this way, for once, its either the downstaters' way with this legislative bill or no law at all.

I think Madigan is appealing the decision, but they still have to come up with a carry bill in the meantime. You're right - the big question is gonna be whether its gonna be a "shall issue" or a "may issue" framework. This is going to be an interesting year - seems like we're looking at a  CCW bill and a possible AWB... Talk about one step forward and two steps back.

I'm certain Hawaii is an example of the carry system Il. wants to emulate.

You boys need to be riding your reps like rented mules. This kind of opportunity comes rarely to the Land of Lincoln.

Good luck

I agree. Hawaii has a typical, liberal written, "may issue" type permit system. We all need to let our representatives know what we expect from them. This is a rare opportunity, indeed. We all need to be on point here, regardless of what happens in Washington.

I know several of my friends back there are giddy with the opportunities that lay before them.

I wouldn't even wait for them. I'd at least get started & get a UT or FL non-res CC permit. I know the use is limited, but it can be handy.
