The competition, more conjecture than reality two years ago, has intensified as the Boy Scouts of America organization — which insists recruits pledge to be "trustworthy, loyal, helpful, friendly, courteous and kind" — has unfairly recruited girls lately, according to claims in legal briefs filed on behalf of the Girl Scouts of the United States of America.

The lawyers filed papers in Manhattan federal court Thursday to repel an effort by the Boy Scouts to toss out before trial a trademark infringement lawsuit the Girl Scouts filed in 2018.

Last month, lawyers for the Boy Scouts asked a judge to reject claims that the Boy Scouts cannot use "scouts" and "scouting" in its recruitment of girls without infringing trademarks.

The Boy Scouts on Saturday pointed to legal arguments in which it blames the Girl Scouts for reacting to its expansion plans with "anger and alarm" and said the Girl Scouts launched a "ground war" to spoil plans by the Boy Scouts to include more girls.

In a statement, the Boy Scouts said it expanded program offerings for girls "after years of requests from families" who wanted their boys and girls both participating in its character and leadership programs or for other reasons, including a desire to become an Eagle Scout.

"We applaud every organization that builds character and leadership in children, including the Girl Scouts of the USA, and believe that all families and communities benefit from the opportunity to select the programs that best fit their needs," the statement said.

In its filing, the Girl Scouts said the Boy Scouts’ marketing of expanded services for girls was "extraordinary and highly damaging to Girl Scouts" and had set off an "explosion of confusion."

"As a result of Boy Scouts’ infringement, parents have mistakenly enrolled their daughters in Boy Scouts thinking it was Girl Scouts," the lawyers said, adding that this never occurred before 2018.

In its statement, though, the Boy Scouts said: "To imply that confusion is a prevailing reason for their choice is not only inaccurate – with no legally admissible instance of this offered to date in the case – but it is also dismissive of the decisions of more than 120,000 girls and young women who have joined Cub Scouts or Scouts BSA since the programs became available to them."

In spring 2018, the Boy Scouts program for 11- to 17-year-olds announced it would change its name to Scouts BSA in early 2019. The parent organization, the Boy Scouts of America, and the Cub Scouts, a program serving children from kindergarten through fifth grade, kept their names.


The organization started admitting girls into the Cub Scouts in August 2018, and Scouts BSA began accepting girls in February, 2019, lawyers said.

Afterward, Boy Scouts councils and volunteers began using Girl Scouts’ intellectual property to recruit girls, employing targeted advertising utilizing terms such as "Scout, Scouts, Scouting, Scout Me In and Scouts BSA," the lawyers wrote.

The Boy Scouts contend, though, that "undisputed evidence" proves that the Boy Scouts have used "Scout" alone for more than 100 years and in connection with the marketing of some co-ed youth services for nearly 50 years.

It said hundreds of thousands of pages of documents produced in the court case and more than 40 depositions of witnesses prove the Boy Scouts never engaged in trademark infringement or created consumer confusion.

The lawyers for Girl Scouts said Boy Scouts councils in Illinois acknowledged improperly using the Girl Scouts’ slogan in Cub Scout recruiting materials and pictures of Girl Scouts to promote a Boy Scouts "Scouts Sign-Up Night!"

If you are confused about which you are, pull down your underpants and look between your legs. If ya got a dangling thingy, you are a boy. If ya don't have a dangling thingy you are a girl.

It's a lot more complicated than that unfortunately.

Part of the problem is the girl scout program sucks in a lot of areas. It's not interesting to girls who might be a tom boy but otherwise feminine. A friend of mine's daughter grew up hunting with my friend. She's only a slight tom boy, she dresses and acts like a girl. She joined girl scouts and hated it but loved the boy scout program her brother was a part of but she couldn't join at the time. Camping, shooting guns and hiking were a lot more interesting to her than baking cookies.

Couple that with declining enrollment due to mismanagement at the boy scouts for years and a generation of boys whose parents used a video game console as a babysitter. Plus a generation of boys educated by feminazi teaches and you have the messed up country we live in today and the reason why a lot of boys don't want to join boy scouts and learn how to become self sufficient.

The BSA is in serious trouble so they decided to start an all girls program to try and add to the declining enrollment. What most people don't realize is girls aren't allowed to join a boy scout troop with boys in it. They are only allowed to form their own, separate all girls troop. The scoutmaster for an all girls troop has to be female. Basically everything is segregated, the only events where girls are allowed to participate with boys is at district events such as the Klondike derby which is a winter survival skills competition. Contrary to what the media tried to sell us there are no girls sleeping in tents with boys or even going to meetings with boys.

Well I was kicked out of cub scouts for mercilessly beating the hell out of another Cub Scout who said he was going to do the same to me. Must say. It was the most interesting part of it. No more cookies, koolaid and crafts in someone’s basement. Worst part was dealing with mom who put up the money for the entertainment I received without membership fees and goofy uniforms  in the schoolyard.

Well we didn't have any goofy uniforms, we wore Cub Scout uniforms. We did a lot of fun stuff, went on field trips, did the "pinewood derby", club dinners with our families, the whole nine yards.
We were kept busy with interesting, and fun stuff to do, so we didn't have any time to fight.
Nuthin but good memories of Cub Scouts.

I look back fondly on my cub scout years and the good men and women who were my leaders. It inspired me to become a leader for my son's cub scout and boy scout years. He made Eagle scout and I loved every second of the journey with him.

I had excellent leadership in Boy Scouts also. Camping skills, community services, camping trips, Boy Scout meetings, Boy Scout summer camp. Great memories.

It has become convoluted over the years with political correctness, and perverted politics.

It will actually be a good thing if BSA national goes under. The local councils will remain but they will no longer be tied to the national rules, they can run the program as they see fit. The BSA was at least smart in setting up the organization so that each council is its own entity and owns their own real estate such as summer camps, etc. Boy Scouts would continue without a national liberal bureaucracy.
