Question about loaded magazines

Hello fellow New Yorker's, I have a question about having a loaded magazine in a motor vehicle in New York State. Other then in a "pistol" when the person has a "carry permit", are you allowed to have a loaded magazine in your vehicle? Lets say you have an AR15 or a Remington model 7400 and your driving to the range, you have a few loaded magazines and you get stopped by the police will you get in trouble? I know if you have a firearm that has a "tube feed magazine" you can't have the magazine loaded. But I don't know about a "box feed" magazine. Thank's :toast:

You can have the magazine (clip)  loaded. But, you can not have it in the gun. If it were in deer country and you looked suspicious they may shake you down a bit, but no it is not illegal.

NY Hunting and trapping regulations guide 2003-2004.. The blue one you get with your license..the one with the pretty girl on the cover with an 8-point buck...

  Column on far right, paragraph in middle of column.

    Transportation of firearms...
A person may not transport or possess a shotgun or rifle in or on a motor vehicle UNLESS the firearm is unloaded in both chamber and magazine...

   (emphasis on UNLESS, theirs)


    I hate to recall how many times I carried loaded magazines in my vehicle before I spotted that  rule!

ironglow, thats what I though, but I wasn't sure. I know if you have a "unrestricted pistol permit" (which I do :lol: ) none of that applies. I got stopped on my ATV while hunting once by a Oneida County Sheriff while I had my pistol. He wanted to give me a ticket for having "load firearm" in/on a motor vehicle. I told him I have a "unrestricted  pistol permit" (which by the way he didn't like) and with the exception of "bow hunting" and the regular places that you can't carry a pistol in N.Y. State I said I could "carry my pistol" where ever I want without explanation. He still gave me a hard time. Finally a DEC officer showed up and told the sheriff that I was right :wink: . The DEC officer said that police officers will either make sure you have a "valid permit" and then let you go as if they could care less. Or like the one that stopped me they will try to make a federal case out of it. He also said that most police officers don't know the firearms laws that well anyways. Thats why I want to be clear on the "loaded magazine" thing.

:eek: I always took that law to mean the loaded magazine could not be in the firearm.
