Fox: Carlson Breached Contract With Twitter Show

Fox News said former host Tucker Carlson breached his contract Tuesday when he released the first episode of his new show on Twitter, reported Axios.

"This evening we were made aware of Mr. Tucker Carlson's appearance on Twitter in a video that lasted over 10 minutes," Fox News general counsel Bernard Gugar said in a letter to Carlson's lawyers. 

"Pursuant to the terms of the Agreement, Mr. Carlson's 'services shall be completely exclusive to Fox,'" it continued, quoting Carlson's contract.

Gugar also said Carlson was "prohibited from rendering services of any type whatsoever, whether 'over the internet via streaming or similar distribution, or other digital distribution whether now known or hereafter devised.'"

Carlson's legal team told Axios that any legal action by Fox would violate his First Amendment rights.

"Fox defends its very existence on freedom of speech grounds. Now they want to take Tucker Carlson's right to speak freely away from him because he took to social media to share his thoughts on current events," said Carlson's lawyer, Bryan Freedman.

Carlson's new show, "Tucker on Twitter," garnered about 80 million views by 2 p.m. Wednesday.

The former Fox News host, in a roughly 10-minute video posted Tuesday and captioned "Ep. 1," claimed that Ukraine was to blame for the destruction of a massive dam in Russian-occupied territory that caused widespread flooding.

The onetime top-rated talk show host on U.S. cable television said he hoped Twitter would be the "short-wave radio under the blankets" with "no gatekeepers."

Fox News Media and Carlson, then its top-rated host, "agreed to part ways" in late April, less than a week after parent company Fox Corp. settled a defamation lawsuit for $787.5 million.

Fox terminates his employment, but considers his contract still in force?

Seems to me they don't have a legal leg to stand on......termination of employment also terminates the contract.

Well Tucker produced his second show yesterday.  I would think that by FOX firing Tucker that would end the contract.

Technically speaking I don't think they fired him even tho that is how it is being framed in the media.

I believe what they did was remove his show from their platform. I believe they are still paying him the same pay as his contract calls for. I believe he is still under contract to FOX until after the elections in 2024.

if he signed a contract and took money for it he should be made to complete the contract. if not any contract ever made is worthless

If Tucker wants to fight "deep pocket" Fox over contract issues, that is his prerogative.  If Fox already paid Tucker contract money for termination, perhaps including a Gag Order as negotiated, then Tucker has "enough" to fight Fox, even tipping into his current popularity. 

If Fox has not paid Tucker for termination, then adherence to the contract is mandated, including any Gag Order therein.  Potentially Tucker could be the BIG looser. 

Tucker is a smart man.  He can hire smart lawyers.  I hope he is not flaunting his popularity and independence over contract provisions, particularly if he has tens of millions of "Fox Dollars" to loose. 

"Telling it like it is" is Tucker's truth and why we listen.  Fighting Big Corp Fox will be just another truth service to Tucker.

OK....yeah.  If he wasn't officially termninated, and is still getting paid by Fox, then he's obligated to follow the terms of the contract.

Now.....let's see if Fox has the clout to strong-arm Twitter.

The thing is Tucker has no contract with twitter. He is not being paid to give his opinion. He is on an open public platform, and he is just giving his opinion like anyone else is able to. Tucker is subject to the same rules and rewards of all other content creators. Fox doesn't have a leg to stand on and Tucker knows it.

Looks that way to me. I'm sure he and Elon had a sit down and figured the path to take. Time will tell I suppose.
