which would be best choice between them both in 3X9X40, there is the $70
price difference, but which is best in quality?

I believe that quality wise it's a toss up. I think the Leupold likely has the better warranty if it is ever needed since Leupold uses same warranty on all their scopes. I think that warranty only applies to the Elite line of Bushnells tho. I'm perfectly satisfied with the Legends I have.
