I am firmly of the opinion that in ALL cases of failure to identify target correct which results in the death of a human the shooter should be charged with FIRST DEGREE MURDER.
Clearly they fired with the intent of killing the target. The target turned out to be a human, therefore they intended to kill a human. That's the definition of FIRST DEGREE MURDER.
There is NO EXCUSE for shooting a human and claiming you THOUGHT it was something else.
