You have to be very careful about offering legal advice.  Without intending to you can create a legal relationship that exposes you to liability.  Plus each state has different communal property laws and succession tables.  The hiring of a local attorney is a great piece of advice.

Well I took everyones advice and tried to talk to her about a pre-nuptial. To say it was somewhat of a failure is to put it mildly.  The response was of course, "you don't really love me".    So....I decided it is not worth it.........I am going pheasant hunting in Iowa, South Dakota and Nebraska instead....Some good always comes out of a bad situation......

Sorry to hear about the bad turn.  Never underestimate a woman's sense of entitlement.

Be patient with her.  The best thing to do is take her out of the decision making path.

Settle your business with your children before you take on a new partner.

That way, what you have is what you have, and anything that came before is none of her affair from the get go.

How come you can't have both common sense and legal knowledge?

Sorry to hear it didn't go well.  I certainly can see how it would be hard to hear.  Some states have minimum maintenance rules.  If your state doesn't you might have the possibility to write your will excluding her and never needing to deal with the prenup.  All the more reason to talk to a good local lawyer.
