Now nabob, there you go being rational and thoughtful.  Rigidity is called for here.  We also must defer to quaint sayings from our venerable forefathers for the way out of this mess.  Surely there must be some ancient slogan, or apothegm that would point the right and legal way to lead us out of the wilderness.

By "quaint saying from or venerable forefathers" are you refering to the Constitution?

Lets sat that they monitor a call today that leads them to an International Terrorist Convention and the nuke it, killing every terrorist in the world.  Do you think that they are going to say "Job well done." and dismantle the program, or are they going to find someone else to listen to?  Speaking of being rational, let's look at the numbers I have posted.  The responce by the US government (all parties, in both retoric and actions) and the media far outweigh the danger to the citizens of the US.  The same as the Dumbocrat and media responce to US Soldiers death in Iraq is being inflated.  Both are tragic.  Both are the price of living in a "free" country.  I think that the systematic securing of our borders is a much more effecint method of preventing acts of terrorism in the US. I also think that if there is an individual or group the is suspicious , do good old fashioned research, get a warrant, and arrest their a$$es.  If found guilty they should get the needle, or better yet, the rope.

Suppose that rather than hijacking those three aircraft, the terrorists had instead bought three light aircraft, put nukes aboard them, flown them  over Los Angeles, New York, and Chicago, and detonated them at optimum altitude? What would the resultant massive death toll do to your perspective?
