Thought I should pass-on this e-mail which I received from the Wisconsin Citizens for Personal Security organization (I'm on their mailing list). I feel it is important to all of us in Wisconsin even if we do not live in Milwaukee County. If Bill SB104 gets passed in Milwaukee County, it won't be long until every County in Wisconsin does it. I already sent my e-mail to Senator Wirch protesting this Bill. It's time for all of us to speak up.

Dear fellow gun owner:

In the next few weeks, there will be a committee hearing on Senate Bill SB104, Senator Spencer Cogg's bill to ban the private sales of firearms in Milwaukee county.

Not only will this bill intrude on your privacy, but it will also make the cost of buying or trading guns with your friends much more expensive. And it won't do anything to stop criminals in Milwaukee and everywhere else in the state from using guns illegally. After all, breaking the law is what criminals do by definition.

Some people are under the mistaken impression that this bill would only affect gun owners in the city of Milwaukee, when in fact it affects every gun owner in the county of Milwaukee.

What's more, this bill will certainly affect gun owners throughout the state. Legislators and their staffers have told us that, if this bill
passes, the ban on private gun sales will quickly spread statewide.

Therefore, it's in your interest to help kill this bill, no matter where you live in the state.

The state pre-emption law, passed in the 1995/1996 legislative session, prohibits municipalities from enacting gun control laws more strict than state law. This bill guts the pre-emption law, and opens the door for a confusing patchwork of gun laws all over the state. Could Madison re-enact the handgun ban the city had in the early 1990's? When we get our concealed carry bill passed, could some communities manage to ban carry?

If this bill becomes law, it sets a precedent that makes the above scenarios very real possibilities.

The committee that is hearing the bill is Senator Cogg's own Labor, Elections and Urban Affairs committee. We have two solid pro-gun Republicans on that committee: Alan Lasee and Glenn Grothman.

Also sitting on that committee is an old friend of ours, Senator Bob Wirch (D-Kenosha). Senator Wirch has consistently voted pro-gun for his entire career in the Senate.

Senator Wirch will be under enormous pressure from the anti-gun leaders of the Senate to vote for this bill.

Your calls to him in the past have helped convince him to vote for our concealed carry bill. Your calls to him now can help convince him to kill SB104.

This is really a myopic bill, I suppose the theory is that it will send their criminals outside the county to pursue straw purchasing. In reality it will pressure the criminals to intimidate currently law abiding citizens into accomplises. I am sure the owner of Badger Guns is also pushing for this, it will help eliminate the competition from cottage industries (private sales and gun shows).

Good post skunk. I am making this a sticky untill the bill passes or dies.

SB 104, sponsored by Senator Spencer Coggs (D-6), has been assigned to the Senate Labor, Elections and Urban Affairs Committee chaired by Senator Coggs and could be up for a vote as soon as the Legislature returns from spring recess

I sent out a few emails today to Senator Robert Wirch. Please do the same. The anti freedom folks are emailing in favor of this to their sponsors, so you best do the same. Consider it your duty and send an email also.

Let the record show (IMO) that this bill, as with any and all gun kontrol legislation, has  nothing to due with reducing crime WHATSOEVER. Rather, it is about disarming the ordinary law obiding Mr American. This bill is just one more baby step at the ultimate goal of them inducing gun kontrol. The antis have yet to figgure out how to simpley take your guns outright, but in the meantime they know all the restrictive legislation will make it a pain in your ass to legaly obtain legal firearms.

Did I miss something here?  I don't see anywhere in this bill where private firearms transactions are prohibited.  What I do see is that if a private party (Non-FFL holder) is transferring a HANDGUN to a private party (non-FFL holder) who resides in Milwaukee County, that transfer cannot legally occur until the seller gets documentation that the regular DOJ background check requirements on FFL to private party transactions is met.

That's a little different than an outright ban on private firearms transactions, wouldn't you say?

While I don't agree with the measure, I also don't agree with misrepresenting what it is.

Not an outright ban per se, as you would still be legal to move handguns provided you involve an FFL dealer, but the proposed legislation bans the way it is done in the rest of the state.

It BANS the way everyone was doing it all these years.

I too sent in some emails recently.  I sent to each member on the committee to try to keep this from even reaching the voting floor.
I agree that it's probably a waste of time, they're going to vote how they want to ( or how they've been persuaded to) anyway, but YOU JUST NEVER KNOW.  Really, it can't hurt to send some easy emails.  All gun owners in WI should be concerned, but whenever I mention it to hunting/shooting co-workers, they think I'm overreacting, etc.

It's kind of scary to think what may be just around the corner in WI ---- and nationally!!

Latest In Milw Journal is this has been expanded STATE wide it would not be fair to impose it in only one county.

Update on Legislation Banning Private Firearm Sales in Wisconsin!

Friday, June 01, 2007

The Tuesday, May 29 hearing held in Milwaukee regarding Senate Bill 104 was successful with more opponents than proponents in attendance.  Thank you to all who attended and made their voice heard.  However, the fight is not over!  Your help is still needed in contacting the members of the Senate Labor, Elections and Urban Affairs Committee.

SB104 would prevent anyone who is not an FFL from “transfering” a firearm to anyone else, including family members, anywhere in the state.  The language does not specify that a sale has to occur, nor does it define what a “transfer” is.  Consequently, an individual who allows a relative or friend to borrow their firearm for target shooting or hunting is technically transferring a firearm in direct violation of the law. 

State Senator Spencer Coggs (D-6) has recently introduced an amendment to SB 104 which would require ALL private transfers of firearms in Wisconsin to be conducted through a Federal Firearms Licensee (FFL).  This bill would also require FFL’s to charge an additional $5 for running this background check for the private sale to be processed.

It is URGENT that you voice your opposition to SB 104 and the proposed amendment that attacks all law-abiding firearms owners of Wisconsin.

SB 104 has been assigned to the Senate Labor, Elections and Urban Affairs Committee chaired by Senator Coggs. 

SB 104 would set a dangerous precedent and threaten the future of gun rights statewide.

It is critical that you continue to contact the members of the Senate Labor, Elections and Urban Affairs and respectfully request that they oppose SB 104.
