US Supreme Court Over Rules Bush and The World Court

The US Supreme Court has over-ruled the Bush administration in a Texas murder case.  An illegal alien raped and murdered a TX girl and was rightfully sentenced to death.  Mexico whined to the World Court.  The World Court came down on the side of the murderer.   Bush ordered the state of TX to review the case.  TX refused and went to the SCOTUS.   Guess that Bush never heard of that thing called states rights.   It makes me puke that Bush came down on the side of the Mexican government and a murdering scumbag. 


"WASHINGTON (AFP) - US state courts need not comply with International Court of Justice (ICJ) decisions, even if the US president orders them to, the US Supreme Court ruled Tuesday in the case of a Mexican sentenced to death.

The Hague-based ICJ on March 2004 ordered trial revisions in the United States of 51 Mexicans sentenced to death, because they had not been timely informed of their right to consular assistance.

One of them, 33-year-old Jose Medellin -- convicted of raping and murdering two teenagers in Texas in 1993 -- demanded Texas courts acknowledge that the omission pointed out by the ICJ warranted a retrial.

President George W. Bush, exercising his prerrogative in applying international treaties, ordered state judges to determine, on a case-by-case basis, whether any of the 51 Mexicans merited a retrial.

While some states complied with his order, Texas judges refused to examine Medellin's appeal on grounds they were not bound by ICJ decisions nor by presidential orders on the principle of separation of powers.

The Supreme Court ruled six to three in favor of Texas' magistrates.

"We conclude that neither (the ICJ) nor the president's memorandum constitutes directly enforceable federal law that pre-empts state limitations," Supreme Court Chief Justice John Roberts said in the court's opinion.

Bush "has an array of political and diplomatic means available to enforce international obligations, but unilaterally converting a non-self-executing treaty into a self-executing one is not among them," he added.

"We're disappointed with the decision," said White House spokeswoman Dana Perino."

Maybe this is an indicator that the courts has finally pulled their heads out of their butts and are ruling according to the will of the American people.  Maybe they will also see fit to put the death penalty back in use.............

I have SCREAMED this for years and this county has put a Bush in the White House THREE TIMES!!! 

I wasn't the courts that had their heads up the butts but rather the voters!

If only the Bush critics were half as smart as he, they may learn something. There are many running around letting their alligator mouths override their hummin' bird butts.
He got this acted on by SCOTUS before Big Ears and The Witch had a shot at it.
If only some voters would understand this is a Legacy to be sure. A very shrewd move on his part. He's probably still laughing at all the idiots that criticized him for it. Have a good one.

I think you give him too much credit.  The administration has urged the SCOTUS to help restrict our right to keep and bear arms, after all.  He's no friend to the Constitution, to be sure.

Sorry but the facts are wrong in this case.  The Solicitor General did, in fact, submit an amicus brief to SCOTUS in favor of DC, solely based on the limitation on weapons types and existing federal law restrictions that may be overturned by the Court.  This would throw existing firearms laws into a huge mess and renewed motions from convicted felons for a review of their case in light of the decision.  THE SOLICITOR GENERAL DID ADMIT AND INTERPRET THE 2ND AMENDMENT TO BE AN INDIVIDUAL RIGHT, NOT A COLLECTIVE ONE.  Also, VP Cheney signed the stronger amicus, along with the majority of US Senators and Representatives in favor of Heller.  An amicus, submitted by the Solicitor General, is not necessarily indicative of the current administration, but of legal interpretation by US Attorneys office.  Many of those attorneys are civil servants with extremely liberal attitudes.  The Solicitor General is one.

   look like today..had Gore or Kerry been elected ?

Even worst than Kerry or Gore..............Obama is elected President and he appoints Hillary to the Court, tell me that ain't a scary thought.

Anyone Gore, Kerry, Clinton or Obama would appoint..would be a disaster..

  The 9th "circus" court may as well just move to the national capital.
