WASHINGTON - The government plans to begin collecting DNA samples from anyone arrested by a federal law enforcement agency — a move intended to prevent violent crime but which also is raising concerns about the privacy of innocent people.

Using authority granted by Congress, the government also plans to collect DNA samples from foreigners who are detained, whether they have been charged or not. The DNA would be collected through a cheek swab, Justice Department spokesman Erik Ablin said Wednesday. That would be a departure from current practice, which limits DNA collection to convicted felons.

Expanding the DNA database, known as CODIS, raises civil liberties questions about the potential for misuse of such personal information, such as family ties and genetic conditions.

Ablin said the DNA collection would be subject to the same privacy laws applied to current DNA sampling. That means none of it would be used for identifying genetic traits, diseases or disorders.

Congress gave the Justice Department the authority to expand DNA collection in two different laws passed in 2005 and 2006.

There are dozens of federal law enforcement agencies, ranging from the FBI to the Library of Congress Police. The federal government estimates it makes about 140,000 arrests each year.

Those who support the expanded collection believe that DNA sampling could get violent criminals off the streets and prevent them from committing more crimes.

A Chicago study in 2005 found that 53 murders and rapes could have been prevented if a DNA sample had been collected upon arrest.

"Many innocent lives could have been saved had the government began this kind of DNA sampling in the 1990s when the technology to do so first became available," Sen. Jon Kyl, R-Ariz., said. Kyl sponsored the 2005 law that gave the Justice Department this authority.

Thirteen states have similar laws: Alaska, Arizona, California, Kansas, Louisiana, Maryland, Minnesota, New Mexico, North Dakota, South Dakota, Tennessee, Texas and Virginia.

The new regulation would mean that the federal government could store DNA samples of people who are not guilty of any crime, said Jesselyn McCurdy, legislative counsel for the American Civil Liberties Union.

"Now innocent people's DNA will be put into this huge CODIS database, and it will be very difficult for them to get it out if they are not charged or convicted of a crime," McCurdy said.

If a person is arrested but not convicted, he or she can ask the Justice Department to destroy the sample.

The Homeland Security Department — the federal agency charged with policing immigration — supports the new rule.

"DNA is a proven law-enforcement tool," DHS spokesman Russ Knocke said.

The rule would not allow for DNA samples to be collected from immigrants who are legally in the United States or those being processed for admission, unless the person was arrested.

The proposed rule is being published in the Federal Register. That will be followed by a 30-day comment period.

They already have it for all the military maybe they should just start collecting it at birth.

Nothing new, I'm sure the civil rights issue was brought up when we began finger printing people too...

I don't know about other States, but in Alaska, anyone who has been arrested for any crime is required to pee in a bottle for drug testing.  There's your DNA.  I don't know for sure that DNA tests are done, but I'm sure that it can be.

I can't see any problem, should help track down bad guys, of course some innocent people
don't want the bad guys caught evidently or they would no have a problem with it.


P.S.
If the aclu is against it that is another good reason to have it.

Sounds definitely unconstitutional and unlawful.  Such info in the hands of corrupt people and government can and will be used against you even if you're innocent. Can you say 'framed'.  This is what the Founders knew what could/would happen and so developed a B of R.  Guess it don't matter anymore.

What about footprints on a birth certificate?  That was the normal standard of id for almost 50 years.  Whether or not your DNA is used for id in criminal cases or fingerprinting of all arrests, the same end result applies.  Identification of a person using biology.  Any corrupt people or governments can use any other means of id to use against you with previous id methodology.  Just substitute the prints of someone else and see if the defense can spot the difference.

I call BS on this.  The DNA is taken from anyone ARRESTED for a federal crime.  If you are arrested in Alaska, you must prove drug free while under arrest.  What is the difference between DNA, fingerprints which are also private sweat marks from you personal body and solely your own, as to DNA.  The same indentification can be made using other means and methods.  As to the comments about insurance companies using DNA for individual actuarial purposes from government records is ridiculous in the extreme.  YES, IT CAN BE DONE.  YES, SO CAN OTHER METHODS BE USED TO ACCOMPLISH THE SAME PURPOSES THAT ARE NOW IN GOVERNMENTS DATABASE.  YES, IT CAN BE ABUSED.  So can every other method of identification currently in existence.  If one looks closely enough at new events, you will see that quite a few convicted murders and other violent crime convictions have been overturned with the use of DNA.  These people were innocent and proved guilty in a court room and with DNA results, these convictions have been overturned.  DNA has assisted in solving long standing violent crime cases and convicted guilty parties that would otherwise go free.  I find no fault with people arrested for federal crimes with having their DNA taken and data based, it is no different than sex offenders being required to register their address with a data base.

No one noticed the lie in the article?

The lede says "anyone", implying there is no selection of who gets sampled, yet when you get into the body we find that only those arrested for felonies or are arrested as illegal aliens get sampled.

That's Associated Press for you.

Universal DNA sampling allows the State to go from "servant" to "master". I don't like it.
