The PRK strikes again
« on: June 29, 2008, 04:32:18 AM »
As an FFL holder I just received notice regarding firearms shipments to an FFL holder in the Peoples Republik of Kalifornia. That in effect, before an FFL may ship to an FFL in the PRK they must first receive a shipment approval letter from the Kalifornia department of Injustice with an approval number indicating that said FFL is authorized to receive the shipment. This adds another layer of bureaucratic bungling on to the already cumbersome need to obtain a signed FFL and Kalifornia is imposing this requirement onto dealers in other states who may wish to ship to a dealer in the PRK. This coming as it does coincident with the supreme court decision on DC just goes to show that the battle is far from over, it's one step forward and two steps back.
The story of David & Goliath only demonstrates the superiority of ballistic projectiles over hand weapons, poor old Goliath never had a chance.

Correct me if I'm wrong but doesn't the ffl already prove that they are authorized to receive firearms? (sarcasm)

Do they have a problem with people using fake ffl's?

I think that this requirement exceed its authority in light of the federal laws on to shipping to FFL dealers.  The PRK by requiring an approval to send from one FFL to another from another State violates interstate commerce clauses already regulated by federal law and enforced by BATF.  Another typical example of abuse from government agencies and its bureaucratic liberal policy heads to restrict the flow and availability of firearms in the hands of its citizens.  I think those citizens of PRK on this site should stronly object to this policy change by whatever means necessary.

Kalifornication has out lawed many guns legal in other states so no just because a person holds an FFL does not mean that all guns are OK to ship to them in that state. They are the least American state in the nation and have the most draconian laws of all 50 states by far and they think they are progressive. In reality they are very much regressive.

I agree with that statement regarding regressive.  I'd think the FFL within the PRK under his business license has the duty not to accept unlawful guns prohibited by State law.  By what other reason would RPK then have, to require an approval for interstate firearms shipments?  I'm not at all familiar with RPK's draconian firearms laws, but I still think any State enforcement or restriction other than that required under BATF and federal law would violate interstate commerce clauses.  One of this session's Supreme Courts rulings was regarding Maine's legal requirement that interstate shipping companies, into and out of Maine, be required to view a person's ID and age before accepting and delivering packages.  The law was intended to reduce underage smoking and internet sales on tobacco.  The Supreme's overturned the Maine law for undue restrictions on interstate commerce.  I use the same reasoning in the RPK case.

Might not be the same thing. California has chosen to outlaw products that are perfectly legal in most other places. The product is illegal to own in that state period it's not a matter of how old you are or asking for proof of legal age to own or possess. Still it seems that an FFL holder is expected to know all laws local, state and federal so it's his job to know if the gun is legal to bring it or so it would seem to me. It's just that PRK feels a need to go over and above on all strictures.

Just another way for anti gun bureaucrats to hinder firearms owners and restrict possession.  When I went to submit my CCW paperwork in Alaska, the elderly woman clerk refused to accept my physical address because it did not have a street and house number on it.  When I related that there is no town or local government where I live, there was no identifiable address as such.  The form was explicit in filling out the physical address in the State.  She became indignant when I refused to list a street address or phony one up to submit the permit and would not accept it without one.  I wasn't going to perjure myself on the application.  Finally a Sgt in the Troopers came from his office when the exchange got heated.  When it was explained, he told the clerk that she must accept the application and if all fields were filled correctly, the background checked out, a license must be issued.  She vehemently argued this point with the Sgt in front of me.  I finally told her that she did not have the right to interpret the law as it was written and that any interference would be reported to her supervisors in a must issue State.  I would adamantly support her termination from State employment if her attitude didn't change.  I went with my brother to get his permit and she was no longer employed with the State.  Why she left, I don't know but I'm glad she did.  The anti gun bureaucrats in government offices give firearms owners more trouble than the laws themselves.

this is funny. on another 'gun' web site I referred to the Pipples Demokratik Socialist Republik of Kalifornication.  I was issued a Warning for 5 of maximum 10 points, at 10 points I would be suspended from the forum. What did I do? I dared to raise the ugly spectre of politics and was disrespectful of the state of california in my characterization of the state.  I emailed the owner of the site, called him a dictator and told him I had obviously overstayed my welcome and all communications from his site are now blocked.

The DOJ here in PRK,is an absolute "authority" to our safety.
They do drop tests, etc. In effect, destroy the "questionable" gun for our safety.....
Then, they at DOJ,has the gall to request payment (DOJ) after the tests are done,to import said "safe" firearm(s) into this state.
As long as those, uh,"fees" are paid, then it's OK for importation.
If the fees aren't paid, then the firearm(s) goes on a "black list",which even if the FFL owner
can't recieve it.
This is it in a nutshell.
Sorta like extorsion in a way.
SharonAnne,good for you ! ;D
