advice needed..im in trouble
« on: April 15, 2009, 09:56:50 AM »
yesterday while entering walmart..i witnessed an guy with a dog insulting an elderly cashier because she said management didn t allow dogs in..i made the comment smart or not, that he ought not talk to that elderly lady like that.. so the normal thing happens me who won t accept being old accepted his challenge to take it outside..
guy was good ,very good an in his pime.. my shoulder caved in with my first left hook..id wondered if it would ,now i know..
anyway walmarts film doesnt have audio an film shows us having words an me following him out side..the clerk told her story but was pulled back after management saw the film.. to them it looks like i started the thing, even tho the films got to show the dog in the store..wife say mabe don t hire a lawyer as this film ,i ll bet looks pretty incriminating..its almost as if a certain ex soninlaw might
have set it up ..as he knows how i feel about bullys..yes he really thinks like that..
but thats beside the point, any advice other than be smarter next time wanted, before court day may the 20 i believe..i may be charged with assualt [no weapons involved] an may be convicted ..
never had legal trouble like this before, and its a long way from being the first time ive iterceded on the part of a weaker person..
thats why im thinking it might be a set up ..as too many things fit
to make it look like i started the thing..im prettiy sore but hit me with your best shot. slim ps guy has no injuries other than an pumped up ego
 :)

I think I would definately get an attorney and make sure they show all of the film and not just the argument. Also I would think the woman you stood up for would be glad to be a witness. Unless they threaten her with losing her job.

As for being sore, sometimes doing the right thing hurts. You did do the right thing though.

Who filed the charges, the kid that beat you up? Or did Walmart call the cops.

+1 w/ what GJ said.

You said you had court.  Who was charged and by whom?

Get a Lawyer- NOW!
I spent a career as a Probation/Parole Officer. Sat many, many hours in court listening to cases like yours. You ain't got a chance. Had many people on my caseload with stories similar to yours: "Honest Your Honor, It was Self Defense".

Slim -

Get a lawyer asap.  If you can't afford one, most towns have low cost legal aid, based on your income / age, or local universities that provide legal aid as part of their student course work.  There may be other camera views available, other wirnesses you did not see, or facts you are unaware of, as people tend to get tunnel vision under stress.  You pay a lawyer not only for his knowledge of the law, but his ability to stand back, and view something with an unbiased eye.  Most juries, criminal and civil, don't take kindly to a guy thumping another guy old enough to be his father.  Good luck

If you told this story to anybody or discussed it with police before you talked to a lawyer. You will be pulling a lead sled up a steep rocky slope.  luck!
