is this legal in n.c.
« on: May 07, 2009, 07:36:56 AM »
right now i keep my best rifle wrapped in a thick blanket behind the seat of my truck..i keep the bolt at home.. this to avoid losing the only gun ive ever owned that could not be replaced ,i fear.. its on the money exactly in a good shooters hands.. i have a ccw license an have never had a lawman even look at my ole truck.. i keep this ole truck in an effort to be less attactive to thieves..so far its worked.. short of a couple o pit bulls ,i don t know a way to prevent an home invasion tho..but id like to know for sure im not taking a chance on the law confiscating my rifle..without a way to fire a projectile its not really a weapon, without the bolt .. i hope im on pretty solid ground as theres little justification for spending more on a safe than my guns cost.. i don t keep guns to just sit there unused ..my home protection stuff is placed around the house so my wife can get to one quick.. and yes we are careful to put them under lock an key if grandkids are coming..thanks for any input .. slim

Slim...With that bolt out, it's nothing more than a club...It's my opinion you are fine...

I keep most of mine at home and just pray that they are there when I get back...

The bolt being out does NOT likely change the category of it to other than a rifle aka firearm. Whether it's legal to run around with one in the vehicle in NC I have no clue but here in Bama it is and it don't have to be partially taken apart either.

The cops would tear your truck apart looking for the bolt. Probably not a good idea since you mentioned a while back about a pending assault charge. I don't think they will believe you that the bolt is at home, they hear lies all day long from people trying to get out of tickets or stay out of jail.

Talking with the game Warden in NC when I was last there, He came out to our farm looking for his father that hunts our land and asked him about fire arms in the truck.
He said that a handgun loaded is OK but not a loaded long gun.
You are not allowed to hunt from the truck so there is no reason for it to be loaded in the truck.   A loaded gun in the truck and the mag counts.
The pending assault charge is another issue all together.  I also guess it would depend on where in NC.  Out in our little town guns during hunting seasons are normal, in a larger city like Charlotte......
I think your best bet is to stick the rifle in a buddys safe at his house.

I wouldn't have brought it up if it wasn't relevant, the cop knows about the charge before he even gets out of his car, you are starting with one strike against you already.

I would have to agree that finding a close friend or family member with a fireproof safe would be the best bet.  Myself, I would be more worried about somebody breaking into my truck just because they are a jerk and stealing my rifle than I would be having it locked up at home someplace...

Agreed, your odds are greater too on getting stopped and harassed by the police than getting burglarized, just hide it good at home if you don't have a safe. I'm not real worried about a burglary since I have a drug dealer living next door that the cops watch pretty close ;) My great dane and boxer don't like obama supporters very much either! ;D

It's not the deputies.  It's the WRC officers that are rotated, and those troopers along NC Highway 8, and 49.

Greybeard's right.  Legally, as far as gun laws go, your rifle will still be considered a firearm and "concealed" if it is wrapped up and accessible.  Longguns are not covered under a concealed weapons permit.

You would be granted a pass after it was established as inoperative for any game violations, but that would only come from the court or DA after the confiscation and/or trial.

Find a fire blanket, or perhaps a surplus fire coat from the FD to wrap it up, and hide it in the house somewhere.

In NC as long as the gun can NOT be accessed with out getting out of the vehicle first, it is legal.  But if you have a pending assault charge I would not suggest this at all.   Save money and buy a safe!  Also using a fire blanket or a turn out coat will not work.

Slim said he couldn't buy the safe, hence the coat/fire blanket suggestion.  In a total loss type of fire, nothing compares to a good fire safe, but luckily, many fires are not that bad, and those items would give some protection in case of a smaller or localized fire.

Besides, my turn out coat certainly saved my butt back when public service was my living.

I know what you mean,  mine has saved me too,  but  I just didn't want to give him false hope many people think Turn out gear is a suit of armor which it is not.  You must also consider the water damage even if the fire and heat don't hurt it.  I guess it would be better than nothing.

I asked the question of one of our LEO's. He told me it needed to be in the cargo campartment. The area behind the rearmost upright seat in a truck or van is considered the cargo compartment.

Wrap the gun in a silicone treated gun sock, place it in a length of pvc pipe with end caps and stash it in your crawl space under the house.

good suggestions.. bret the pvc with end caps would also work to hide guns underground ..if we ever needed to.. ive thought of that.. just dig along your sewer line an put it right over the existing line an bury it..
that way no sound equipment may find it.. this assuming your area over the existing pvc is dry.. slim..
im just gonna go to sheriffs office an ask the fella that issued my ccw what,or how, this areas leo s or gonna react to this.. ive lived here 30 yrs. up to now and any differences i had with a person ,were handled in the woods or ring..just so i wouldn get the law involved.. i had ,had being the operative word.. a clean record.. boys when your body gets wore out ,,your mind may not be far behind.. slim

Slim, send me the rifle and don't forget the bolt; I'll keep it safe for ya.  Don't worry about me using it, I've got plenty of my own.  I provide this service, free of charge.  But you have to pay for the shipping.

Slim, sounds like you got the same answer I did. By the way, we live pretty close to each other, curious how the rest of the state sees it?
