Casull:  Lots of times the prosecutor knows the person is innocent, but refuses to admit it.  A conviction looks good on their stats.  That is all they focus on, stats, that is what gets them promoted.  If they hang an innocent man, Oh well no skin off their nose.  Look at all the convictions being overturned today due to DNA evidence.  At the time it was obvious to many the prosecutor was manipulating the jury, but it happened and the person was convicted.

I've been on the grand jury when the prosecutor tried to manipulate us and we resisted, the prosecutor was furious when he did not get the indictments he wanted.  In one case it was obvious he was going after the wrong person, just he refused to see that.  He was willing to ruin a young high school girls life, just for a trial and his stats.

Sourdough, are you trying to say that defense attorneys don't care about stats as well?  They have no qualms about loosing a killer or rapist on the public, as long as they win for their client.

Casull, I dealt with both sides of the coin. It's about winning, money, and records. Plea bargains look like wins on paper, and make excellent running for higher office stats.
Winning on the defense side means reputation and higher fees, and maybe an office run later.
Sourdough is right about prosecutors also. They sometimes let their ambitions blind them.
But think about using every trick in the trade to get a child molester off. Just an example Sourdough used. If it's a young girl say, twelve to fifteen years of age, that has been molested. The defense attorney will attempt to destroy her reputation, and make her look like a whore. He will do everything in his arsenal to convince the jury that it was the young girl whom was at fault. Have seen it myself, and then the same attorney will make big donations to his church, and charities, and everyone will talk about how generous he is, and what a civic leader.
It comes from both sides of the bar, with both the prosecutor,and the defense attorney indignantly swearing and defending that is all in the name of justice, fairness, a fair trial  ::), and the judicial system.

Interesting discussion.
I don't think I can go along with all the deal making I have heard bantered back and forth here.
procecutors normally will deal make when a proposed  charge will be difficult too prove and there is a fair chance that a much less severe pentalty will be awarded.
Most defense attorney's will suggest a lesser penalty Just to test the waters.
Jury selection will not give either side an advantage or disadvantage.
I have friends in places that do such interrogating---they dig until they get what they want. If all the ierrrogation was done with an attorney present, the police would be hamstrung, the same if all iterrogation was recorded in the full.
Each side comes with a biased front. Shame that the procecution does not work as hard at justice as it does at conviction.

this is one subject i do have knowledge of...

everyone here that claims to love this country should clearly understand why even the most digusting scum are entitled to the presumtion of innocence and the right to be defended vigorously. i have been on trial for my very life once a long time ago..thank god that i was able to defend myself..i took the stand in my own behalf against the strong advice of my counsel. i was aquitted by a jury of my peers consisting of 6 women 6 men. in my case the system worked it worked as it should have worked but sadly that is not always the case. i could have just as easily be on death row or spending the rest of my life in huntsville texas prison. i consider myself very lucky and not one day has gone by in my life that i do not give thanks to god for sparing me.

many innocent men and women have been sent to prison in this country many died there others with there lives destroyed killed themselves or drifted into oblivion.

the stories of unjust proscecutions and out right fabrication of so called facts are true in many more cases than we will ever know. the prosecuters and the judges and yes even the cops have done unspeakable crimes yet so many times they are let off the hook. it is my opinion that anyone that sends anyone to their death or to prison on trumped up charges and false testimony...anyone that had a role in that should be sentenced to no less than life in prison themselves and if a person lost their lives because of something like that they should be put to death.

Well enough of that crap..back to the subject..give this scum his day in court it is the very least we can do is prove his guilt then mete out the justice he deserves. I certainly feel he does not belong in civilian court..however that decision has been made by the obama clowns.

hassan is going to be tried by the military is my understanding..the 911 mastermind and 5 others i believe are going to federal court in new york...my mistake.

You got that right, it doesnt get much truer than that!  I am so glad to be retired now.  I just couldnt take the PC crap anymore.  While the military does have the death penalty they wont ever use it again.

You know something--and this is not in defense of this slime bag--I am concerned, too some undfined degree, about the death penalty.
I feel that it is a worthy law---yet---with so many overturnings of these sentences of late, due too new evidence or otherwise clear evidence of being not-guilty, gives me some amout of concern about those who investigate and procecute these charges.
It is too late for those whose sentences have been carried out.
I am of the most firm opinion that any person who cannot be proved--by all evidence--to be absolutely guilty should not face the death penalty.
I know, I know, I am just a liberal scum sucking slime bag---but that is what I think.

A few here took this as that I don't think there should be a trial. That's not what my intention's were. He should get a trial, last about 15 minute's. My point was/is, it has to a person made from a different cut of cloth, to be able to try and defend somebody like this. When there is 100% certainy, that the man is guilty, I couldn't lie like that. Don't care how much money is involved. Hope he burns in hell! gypsyman

I doubt very much that the Defense council will debate whether or not he did the shooting. Defense will plead mental disorder, stress, blah blah blah etc
