Why doesn't the article say he was a convict? Or maybe the prison orange in his mugshot is his hunting outfit. I am so sick of the liberal press that makes scum like him look like the victim when they get their just reward, unfotunately it had to be at the hands of an old lady who will live with that on her conscience.

The sad thing is, this will affect this lady her entire life.  I hope she comes to term with it.  Unfortunately, even in metro areas, quick police response is not always possible.

Reading the comments---I think.
I am constantly amazed at folks who second guess when they are not there.
Now--if I was to second guess her--I might suggest that she could have avoided all the red tape if she had a back
hoe and had not of called 911. ;)
On a serious note--she did all things correctly. Will it bother her? Yes---and for along time. I pray that she can find peace witin herownself for Christ has already forgiven and forgotten.
Blessings

Seems like a strange story. Did she really have time to call 911 and at least ten minutes more? Would a crook really spend that long breaking down a door? Why would the cops investigate it as a homicide unless there was some evidence that led them to make that decision?

Killing someone is homicide . They must determine if it was justifyed or not . People on drugs often do things that seem stupid , so he may have wondered around trying to get in . He may not had any sense of time .
And a big shock to many is police investigate more crime than they can get to and stop . The days of one cop showing up and going John Wayne are far and few these days . They come in teams or groups . I had the unfortunate pleasure of seeing two murders and shootings . It took over 30 mins for police to show up . The shootings took place less than 10 blocks from the jail. Less than 12 from the Main police station and less than 12 from the state capital building .
If ya can see it ya can hit it !

That makes a lot of sense. One more question though: Are man slaughter cases initially investigated as homicides? Or just when there's a weapon involved? I don't know much about this stuff.

Don't really know . Would assume it would depend on the case and what the police found when they showed up . I expect the invistigation would be the same though . The DA might make the choice after reviewing the evidence.

I think Oklahoma is pretty much like Texas, once he breeched the security of her home and threatened her with bodily harm he was fair game.

Texas has a “Castle Doctrine” law which protects the shooter in their own home or on their property.  The key here is, “I thought my life or the life of my family was in danger.

Based on what I read on this case and with his past record she will walk or be “no billed.”   She will have to live with the fact that she took his life, but hopefully she will assume the attitude it was me or him.”

Pray for her mental stability and peace of mind.

Yesterday, the Lincoln county, OK DA gave the lady a pass.  It took all of four days.

http://newsok.com/law-allows-fatal-shot-lincoln-county-official-says/article/3423575

Quote
The intruder’s motivations for breaking into her house may remain unclear, but the action taken to stop him was a clear exercise of a homeowner’s rights, District Attorney Richard Smothermon said.

Smothermon issued a ruling Tuesday that Donna Jackson had the legal authority to shoot and kill Billy Dean Riley about 12:40 a.m. Friday. Smothermon said he has declined to file any criminal charge against her.

Jackson, 56, was standing in her home south of Cushing on Friday with a shotgun when Riley, 53, used a patio table to smash through a glass patio door, Smothermon said. She opened fire and the shooting was recorded as the 911 dispatcher talked her through it.

The dispatcher had told her, "you can defend your property.”

Smothermon ruled the shooting is justified under the state’s "stand-your-ground” law, which allows a person to shoot an intruder in a home. Riley was lying dead on the back patio, with his feet inside the door threshold, by the time deputies arrived.

I wonder what would have happened if she just shot him in the knees and left him there until the cops arrived?  She'd probably be in court forever facing law suits for injuring and crippling a criminal, not to mention a complete loser.  Of course, she'd probably lose in court because people in this country don't side with gun owners so she would have probably lost her house and everything else and then left to live on welfare....where everyone else can pay for her court costs and the rest of her life...not to mention to pay for the idiot that she shot in the knees.

I cannot help but quote a line from a song by a Kansas City rock band, "The Rainmakers" from the late 80's:

"They'll turn us all into beggars because they're easier to please, they're feeding our people that government cheese!"

I think the DA difinitly made the right choice here. I also like how in the report he states. Mr. Riley’s body was found with his feet inside the threshold of the residence. I hpoe this woman can put this behind her. Dale

That is one of the prices of a Republic.
If you want a Republic you have to face these confrontations on your own. There is really no safety net of people or agencies that can help you---she needs to face these demons down--on her own terms. Some do and some don't---either case doesn't make you a bad person--but nobody but you can stand in that place in time.
She will do fine---it will just take longer than a good nights sleep.
Blessings

In listening to the 911 recording, the lady never lost her cool. She was calm all the way to the end.

With the best of regards,

Everyone down here has said job well done.
Also everyone hopes she can put it behind her.

Have you ever wondered why we never read stories about a robber who was overpowered by the victim, tortured for weeks, disembowelled while alive, cut into little pieces and turned into sausages, then served to prisoners at the local jail?  Well, me neither, but it would add a little color to "The Armed Citizen" column in American Rifleman.
