Pro-Gun Bills Pending in the Georgia General Assembly
Four Second Amendment-related bills are on the move in the Georgia General Assembly. The following bills have passed in the state Senate and are now making progress in the state House:
Senate Bill 26, sponsored by state Senator David Shafer (R-48), is an important “Emergency Powers” bill. SB 26 would protect our Second Amendment rights by prohibiting any government agency from confiscating or regulating the lawful sale, possession, transfer, transport and carry of firearms during a state of emergency, such as occurred in the wake of Hurricane Katrina. SB 26 passed in the state Senate by a 40 to 12 vote on March 11 and is currently awaiting action in the House Judiciary Committee.
Senate Bill 94, sponsored by state Senator Bill Heath (R-31), would fix the regulatory gap relating specifically to long guns by clarifying the definitions of both long guns and handguns. SB 94 passed in the state Senate by a 50 to 1 vote on February 28 and is awaiting consideration by the House Judiciary Non-Civil Committee.
Senate Bill 98, sponsored by state Senator Barry Loudermilk (R-52), would expand the Right-to-Carry in various public venues with the exception of a jail, prison, courtroom, nuclear power plant, state mental health facility, or county or municipal government buildings. SB 98 passed in the state Senate by a 43 to 10 vote on March 14 and is currently awaiting action in the House Public Safety and Homeland Security Committee.
Senate Bill 102, sponsored by state Senator Jeff Mullis (R-53), would reform the Right-to-Carry in the following ways:
Change terminology/definition from long guns to rifle or shotgun to match federal definition and close existing regulatory gap.
Allow license holders to carry in any area of an airport not prohibited by federal law.
Allow persons to carry in school zones while picking up or dropping off someone or while waiting to do same.
Eliminate fingerprinting requirement for license renewals.
Place the burden on the medical professionals treating the individual and not the judge, wth regard to the mental health disease prohibitions,
Remove prohibition from carrying in places of worship and property.
SB 102 passed in the state Senate by a 41 to 11 vote on March 16 and is expected to be read in the state House and assigned to committee as early as Monday, March 21.
