Interesting Cannon Legislation from Maine
« on: June 15, 2011, 08:54:02 AM »
Attached is a PDF of a piece of legislation that was just signed into law in Maine.  I thought you might get a kick out of the justification used to get it considered as an emergency piece of legislation.

So a salute cannon is NOT "fireworks" as defined by the new legislation.

You gotta love it:

Quote
An Act To Modify the Regulation of Fireworks
Emergency preamble. Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and
Whereas, there is a movement to bring historical artillery pieces to Maine to promote a unique cottage industry for Maine craftspeople that will meet the global demand for antique cannons; and
Whereas, this cottage industry employs workers in shipbuilding trades and creates jobs that help strengthen Maine’s economy; and
Whereas, Maine has a proud and vibrant maritime history that includes the use of signal cannons at sunset, in celebration of our country and during times of nautical celebration; and
Whereas, ceremonial uses of signal, antique and replica cannons for public entertainment, yachting events and historical reenactment promotes tourism; and
Whereas, to promote tourism, this legislation must go into effect before tourism season; and
Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore

Actually Dom this is a perfectly good reason why we don't get into legal discussions on this board. What is the difference between a toy cannon in which explosives are used and antique or replica cannons if no projectile is fired?

I think the legislators intent is pretty clear...but how will some prosecuting attorney interpret that.  Is my 50 cal cannon a toy? Can a toy cannon be a replica or antique?

I can tell you based on my 34 plus years of law enforcement that law is vague.  I

The only answer can come from the Attorney General of Maine.

Well put!

The only advice we can/should/will give is for y'all to get good advice from your lawyer.

It is interesting that there are some reasonable-appearing bits of legislation coming through.
