the Indiana supreme court says that people do not have the right to resist police that try to enter their homes by mistake are without a warrants. it said the 4Th amendment does not apply and if it happens you should settle in court.

This is actually very interesting, in that it opens the door for absolute tyranny and oppression. The judge says you can settle in court huh?  Well thankyou komerade kommissar.

I would think that the finial decision will have to come from the Supreme Court. I know that in order to get a search warrant you must have not only an address but a total description of the residence you want to search and what you are searching for. We in SC have been thought that we can't enter a home unless we have a warrant, we are invited, or we are in hot pursuit; (Hot Pursuit is when I am chasing a suspect who has committed a felony or serious misdemeanor and I see him or a dog who is on the track and they go into a residence.) We can also enter under extreme Circumstances (to render aid, protect evidence, etc.).

i sure hope the us supreme court reverses this. i understand what your saying Matt and it was that way here until this came along. i guess there have been to many cases were the cops made a misstake and got hurt are shot.  so now they cant make a misstake

Is there anyone who thinks you will stand off the entire police force? Because if by some chance you do, there will be a more powerful force arrive to continue the cause. Anyone remember Waco?

Now that I have said all that, it should not be construed to mean I like it or agree that this is a good idea. It could very easily become the slippery slope. The proof will be in the pudding as to how judges treat these cases going forward. Having lived in Indiana I am inclined to think they will get it right.

In context, I believe that the ruling is intended to provide police officers the authority required to prevent the loss or destruction of evidence.

Like any ruling which grants a greater authority to an officer of the law to use force for any reason, this authority might be, and probably will be, abused.

That said, I fully support the right of any free man anywhere on earth to defend his castle against unwelcomed invasion by the use of deadly force.

The court is letting you know you will be shot right back. Your family won't have any standing suing the state for your funeral or wrongful death and you will still be dead.

 I'm going to guess that you identify your target before you shoot?  Do you routinely have a dozen armed burglers coming into houses in your area?

Shooting at the Po Po won't work. Do what they tell you to do, follow up in court. Remember this, the officers are humans, they are capable of mistakes on the job. If they are at your house incorrectly they will have a lousy day all around. When you start shooting it immediately justifies there suspicion that you are a bad actor. They still have the lousy day, no doubt worse, but you are dead. Live to sue them and cash that Hoosier millions check.

To answer the question in the thread topic line, They will stop when we as freemen put our foot down on their necks and start acting like masters instead of servants.

no, that's for hunting.  if someone kicks in my front door, he WILL die.  what's that old saying about he who hesitates?
