Louisiana bans cash for used goods.

       Law Bans Cash for Second Hand Transactions Posted:  Oct 18, 2011 5:58 AM EDT               Cold hard cash. It's good everywhere you go, right? You can use it to pay for anything.
But that's not the case here in Louisiana now. It's a law that was passed during this year's busy legislative session.
House bill 195 basically says those who buy and sell second hand goods cannot use cash to make those transactions, and it flew so far under the radar most businesses don't even know about it.
"We're gonna lose a lot of business," says Danny Guidry, who owns the Pioneer Trading Post in Lafayette. He deals in buying and selling unique second hand items.
"We don't want this cash transaction to be taken away from us. It's an everyday transaction," Guidry explains.
Guidry says, "I think everyone in this business once they find out about it. They're will definitely be a lot of uproar."
The law states those who buy or sell second hand goods are prohibited from using cash. State representative Rickey Hardy co-authored the bill.
Hardy says, "they give a check or a cashiers money order, or electronic one of those three mechanisms is used."
Hardy says the bill is targeted at criminals who steal anything from copper to televisions, and sell them for a quick buck. Having a paper trail will make it easier for law enforcement.
"It's a mechanism to be used so the police department has something to go on and have a lead," explains Hardy.
Guidry feels his store shouldn't have to change it's ways of doing business, because he may possibly buy or sell stolen goods. Something he says has happened once in his eight years.
"We are being targeted for something we shouldn't be."
Besides non-profit resellers like Goodwill, and garage sales, the language of the bill encompasses stores like the Pioneer Trading Post and flea markets.
Lawyer Thad Ackel Jr. feels the passage of this bill begins a slippery slope for economic freedom in the state.
"The government is placing a significant restriction on individuals transacting in their own private property," says Ackel.
Pawn shops have been forced to keep records of their clients for years. However under this bill they are still allowed to deal in cash.

I think they might have some problems with the Feds on this (assuming Obama actually does something productive).  You know, that whole thing about US currency being legal tender for all debts, public and private.

When will they grow a brain and realise that criminals don't abide by the law? Those buying and selling stolen goods will still use cash anyways. Criminals are usualy stupid but obviously they are smarter that out elected oficials! Saddly the only people getting hurt, as usual, is the honest citizen! Another fine example of our Government knowing better than we what is good for us! I see it as another stab in the heart of our economy! Look around folks, this Country is being destroyed from within by those we are suppose to be able to trust!

Lets see, you run a scrap yard, and you have regulars who bring you the innards of heat pumps in bulk......and you buy it.......there's two crooks involved.  I betcha' this law changes nothing.

OK,
I see that more of a tax grab, at least it would be up here. People deal with cash under the table as much as possible to escape the high sales tax on just about anything.

It's unconstitutional. Look at your money. "this note is legal tender for all debts, public and private".
 
You see, the only folks who can screw you on your "dollars" is the federal government.  However, I'm glad to see that NY doesn't have a monopoly on stupid politicains.  8)

OK so I own a store in La and want to buy something from you.
We work out a deal and I write you a check.
I can then cash the check for you.  You walk in with an item and walk out with cash.  Ta Da!  Law followed.
 I think it would be agains the commerce clause in the constitution as well as on all the bills in my pocket say "legal tender for all debts public and private"  I find it hard to follow the logic that you are not allowed to use cash to buy things, unless they are trying to halt thefts and sales to Pawn shops or being able to track the people selling items and go after them for capital gains of some kind.

Of course, this might open another can of worms, which actually occurs in many places in the world: Use heroin or a similar drug with stable street value as a currency.

With fires, earth quakes, riots, Obama, and other disasters I bought some silver and small amount of gold coins.  With Silver and goild being a stable currency for years why not pay out in either silver ( Have 1 Oz coins, 3/4, .6, .5, and .25oz coins when you look at world coins.)  The 13 colonies used Dutch, english and Spanish coins as money before we minted our own.

two years ago we bought 109oz of silver plus we have about 20oz in coins.  it was NOT bought as an investment, it was for spending money in case the dollar becomes worthless.

I've been proactive too. A few years ago I bought some goats, camels, and cattle. They hold their value pretty well too. Funny thing is that some of my local merchants give a discount if you pay with livestock, milk, or cheese instead of dollars.  ;)

I bought for short term. 
If a disaster like an earth quake or a tidal wave drive me from the house and wipes out power, people with hard assests are the ones getting gas, hotel rooms, and food.  The box of Silver I have is only 4 to 5  pounds. easy enough to carry with me if I have to walk.  I like having them and they are a little easier than cash and so far have gone up in value since I bought the bulk of it.
When Katrina hit, there were not ATMs for a while.  Visa, Master card, and american express were woth less.  Cash worked but was limited to what was in people's hands.  You were not getting change.  You wanted a bottle of water and had a $20 you were buying 4 to 7 of them.

Why the big suprise?
Have you tried to rent a car or buy an airline ticket in the last few years and pay for it in cash.
You can't, they won't accept it.
Credit card only.
Stupid, but true and they are private businesses, not the government.
There is no law in the land that can force you to have a bank account or a credit card if you don't want one.
It's just that no one has forced their hand in court over the cash payment issue yet.
Just shows that the country is so into the electronic age that they are willing to do what ever they are told.

Tom, there is a difference between a company accepting something as payment and the government telling you you can not use legal tender to commence in commerce. 
On a regular basis I see signs of we do not accept bills larger than $20. 
The airlines are willing to pay the vig to the Credit card companies rather than have the hassel of the problems with a large volume of cash.  Theft, employee theft, transportation of the $, time for a manager to leave and deposit the cash for a few transactions a month or year, not to mention possiblilty of counterfiet bills.  The No cash from the airlines is a business desicion.  Telling me I can not use cash you are willing to accept for a good is a problem.  Illegal trans actions are still going to be illegal and all you have done is made legal business jump through another hoop.  You have taken people from out of state wanting to sell something for cash and added steps and cost to them.  Laying out a few $100 bills to ghet a good deal on an item is now not going ot be the same as laying down a credit card.  You want 450 for that shot gun, All I have is these 4 $100 bills.  Deal?  now it is going to be different and less will be purchased especally if the buyer does not feel he is getting a good deal.
Hey if you sell old money, can you do that now?  Sell silver certf? to a coin dealer even if he pays you with a check?
