Gun show warning!!!!

This is a good warning look for the guy walking around with the flag hanging out of the gun saying "GUN FOR SALE" he might be carrying something of interest!!!! At one show a guy was carrying a 30-40 Krag and sold it cheap to a guy I was talking to at a table while I was standing there he walked past me twice before I didn't even look at what he had. At the last show there was another guy who had a nice looking "AK" I'm not really into ak's yet but maybe you never know when it just starts right? So look for this guy I'm sure he's at your show too.

Your right it does work both ways we could get more than what we figured on if we were the ones with flags too. I have thought about that too being a walk in seller but I have to sell to another C&R FFL or to an FFL license holder in my state.                                           BigBill

BigBill, I'm very cautious when I see someone walking around a gun show trying to sell anything.  This is the best place in the world to peddle stolen guns.  I bought one myself several years ago, it really hurt when the police came to my house and picked up the beautiful 1893 Winchester, and I didn't get my $400. back either.  I will still buy, but I ask the individual for some kind of indentification, I record their name and address, date and place I bought the gun.  In the future, if I do buy one thats stolen, and the police come knocking on my door, I want to be able to provide as much information as possible on the individual I bought the gun from...........I also try to get information for my records when I purchase at Estate sales, garage sales, etc.  Ain't nothing wrong with covering your butt!

I always wondered how anyone can legally buy a gun from  someone like you describe, on the floor of a gunshow who isn't a registered dealer?  Doesn't the buyer have to arrange the sale through an ffl agent?  Are there ffl agents at every show available just to handle these walk-in sales?  I know that here in NY, every person walking in to the show must register their guns at the door, before entering.  How does this transaction legally take place?

What if you bought from a guy at a table with no ffl? same thing? as long as you get a bill of sale and his name and address and drivers license number too. just get all the info you can.           BigBill

There is no federal law requiring paperwork or background checks for private sales regardless of whether they are made at gunshows or elsewhere.  Some states have passed laws that require that any transaction of any firearm must go through an FFL.  Some states do not.  

In Oklahoma, for example, I can go to the gun show and buy anything I want from a private individual without paperwork, but to buy from a dealer, I would still have to fill out the yellow form.  If my neighbor were to decide he wanted rid of a firearm of some flavor and I wanted to buy it, it would be a private transaction and no paper work would be required.  

Transactions made the same way in some of the more socialist leaning states would be illegal because of state level laws.

Like Security Six mentions, private sales between individuals require no paperwork, background check, etc.  The gunshows I go to in Ohio you pay your cash, get your gun, end of story.  Most buyers and sellers would be suspicious if you ask them to sign something or record their personal information.  That's why we still have freedom (for a while anyway) to trade in guns without big brother over our shoulder.

Having said that, I try to size up who is interested in buying a gun I am selling.  I won't sell to someone who appears to be a gang banger or thug.  I have sold several guns at the shows for a decent price.

:agree: I agree with big bill.  I used to have an FFL, turned it in and got the C&R as that is all I am buying now, and it keeps ATF away from the door.  GET A BILL OF SALE!!  Get as much info as you can from the seller.  If you are selling, make sure you know what you got and make sure you give all info to keep your tail clean.

Case in point.  I work for a large insurance company.  I shoot competition and have trophies at my desk, so everyone is aware that I am knowledgable on firearms.  Had a claim rep call me on a recovered firearm that we had settled on a claim wanted to know about paperwork and selling etc.  I found out that an insured person reported it stolen from a pickup while he was carrying his elk out of the woods.  It was recovered at a gunshow about 1800 miles from where it disappeared from.  The gun had been sold to another party, and another, and another, and, and ......anyway,  They were able to trace the gun back to the guy who originally picked it up.  Not out of the pickup, but from laying against the tree in the woods where the hunter left it.  Got so twitterpated about getting an elk that he forgot to put the gun in the truck and left it leaning against a tree on the side of the road.  Anyway, the case in point, each person who had purchased the gun, had a bill of sale showing when, how, and where they acquired it.  No one got stuck holding the bag on a reported stolen gun.  The only one who suffered was the guy to who reported it stolen after he found out he had forgotten it in the woods.  I guess he was pretty embaraced.  But that's another story.  And yes, we do insure stupidity!!

:-) Steve P, that was a heck of an interesting story. I'd most near die of embarsment if I pulled a stunt like that. Here in Ms. private sales are not regulated except by Fed. law which applies . Yuh cain't sell to a known felon or minor & so on. We've had city council members in Jackson outside the shows rasing a big todo about gun shows,but down here the state does the regulating not the city of Jackson or some loud liberal who wants to be on TV.
