question for lawyers.
« on: December 13, 2011, 11:40:28 AM »
I have been following the Sandusky child abuse trial. It has me wondering if lawyers learn a specific strategy for a specific senerio or does the lawyer's creativity dictate the path a lawyer takes? I wonder this because you often hear lawyers comment" the defense will............."   Are there certain " game plans" to follow?.

The strategy is based on how long the money lasts.

I am not a lawyer but the comments made on the news is based on the type of case and th evidence against him.  The prosicution has a set method of presenting the facts and building the case.  The defense has a few paths based on the evidence, to attack the case and either prove the evidence to be false, or try to raise reasonable doubt, and try to turn reasonable doubt into ANY doubt.
Again there are only so many ways.  Think of the court case as building a house.  The house is built in a certain order.  Foundation, floors walls and a roof.  It does not work if you build a roof first.  Stoping the house from being build, you attack the foundation, then the walls, and finally the roof, depending on how strong the house it is how you would go about attack the  house to tear it down and what tools you would use.

I'm sure with enough cash they can at least get the charges reduced.
I was in a patty wagon many many many years ago, long story don't ask, with a gangbanger that shot someone in the face. His lawyer got it dropped down to aggravated battery.

I'm not an attorney, I just use to deal with them a lot.

Unlike other LEO's, before I retired, I made it a point to be friendly with them.  After all their just doing their job, just as your doing yours.  A couple of the attorneys actually became decent friends.  They all basically told me:  "When you have facts, argue facts, when you don't, dazzle them with your bullspit".  In law school the exact same thing is taught, every first year law student understands it, but it's phrased: "If the facts are on your side, argue the facts, if you don't have facts on your side, argue the law."

That said it means, if the facts are on your side, use them to your advantage, if the facts are against you, obfuscate, twist the truth as much as possible, repeat erroneous statements as often as you can get away with it, and hope the jury will believe it's the truth,  or look for every tiny loophole you can.  Sandusky's attorney will have to see what evidence is presented, before he can formulate a defense strategy.

There is some truth to what magooch said.  Some attorneys will milk you for whatever money they can, before they resolve the case.
The strategy is based on how long the money lasts.
