I think in this case if the person who threw the ticket away could prove that they actually bought the ticket and that the machine did in fact claim the ticket was a loser, the state lotto should have to pay, even though they had already paid the finder.  The lotto program should be responsible for the accuracy of their machine.  I never have trusted those things.  I also never trusted store employees when they used to check your tickets for you and dispose of them.

I don't think the case in question is over yet.

Quote
Hughes found that the evidence weighed in Duncan's favor that she bought the winning ticket, even though lottery records and store security video didn't synch up to the precise timing of the purchase.
Arkansas Lottery Security Chief Lance Huey testified that he investigated the circumstances of the ticket falling into Jones' hands. He said the lottery was satisfied with the investigation and awarded the prize.
Duncan's attorney, James "Red" Morgan, argued that she simply made a mistake by throwing away a $1 million ticket and that the only right she willingly parted with was to enter the ticket for the possibility of a secondary prize

Proves Only the lawyers win
I'd bet they both get a bit and lawyer wins the big prize

I'll be interested to know what the judge's thought process was. I think this can be effectively appealed.

Hmmm? I wonder what the judgement would be if the woman found 1 Million in CASH in the trash and someone claimed they put it there unintentionally?

I don't understand how the woman throwing it away found out it was hers?? Had the trash can been outside instead of on the floor it might have made a big difference. I feel sorry for the one who found it and now has to give it back. POWDERMAN.  :o :o

They should just split it, and avoid lawyer fee's.

How did the woman know it was her ticket that was thrown?  Lotteries are a scam anyway, how many times have you seen a winner plow all the money back into more tickets?

As a rule, I keep my dollar and let some other fool play the long odds.
