In the Dissenting Opinion of Justices Alito, Thomas, Kennedy, and Scalia:
 
 

“YOU’VE EXTENDED FEDERAL POWER TO VIRTUALLY EVERYTHING.  …IT EXCEEDS ALL FEDERAL POWER.”

President Obama said this was NOT a tax increase but they went to court and argued something completely different.
Judge Napolitano:
 

"It's the most bizarre tax in the history of the country because it is not related to your income. It is related to your behavior. And it does not fall on everyone equally. It only falls on you if you fail to comply with what the Government has commanded you to do. And that command, it doesn't have the power to articulate under the Commerce Clause."

It is in fact a tax and not a penalty, or fine, because it is not imposed by a court of law.  It is in fact an illegal tax at the very least because it is levied for something not done to pay for something not wanted.  Something like being handed a property tax bill for fire protection on property you don't own.

Any thinking person would call it a tax and not a mandate but the dems passed it as a mandate. AFA would not have passed if it had been characterized as a tax and the big one it is.
