(NaturalNews) We've seen it in the movies and perhaps even witnessed it in person, but most of us never realized it was an offense punishable with lots of prison time.

When Anthony Brasfield released a dozen heart-shaped balloons into the sky over Dania Beach, Fla., for his his sweetheart, all he wanted was to create the perfect atmosphere of romance. What he created instead was a court date.

According to the Sun-Sentinel newspaper, Brasfield's act of love was witnessed by a Florida Highway Patrol trooper. What he saw was not an act of love but a felony.

Massive jail time for - balloons?

The 40-year-old Brasfield was with his girlfriend, Shaquina Baxter, in the parking lot of a Motel 6 on Dania Beach Boulevard when he released the 12 shiny, red and silver mylar balloons into the sky and watched them float away in the Sunday morning breeze.

But the trooper saw nothing more than probable cause for a crime against the environment. Apparently, lawmakers in the Sunshine State think it's appropriate to treat what should have been, at most, simple littering (to which courts would have issued a fine, maybe?), into a major crime against Mother Nature. As if Florida jails weren't full enough.

The trooper arrested Brasfield and charged him with polluting to harm humans, animals, plants and everything else living under the Florida Air and Water Pollution Control Act.

"Endangered marine turtle species and birds, such as wood storks and brown pelicans, seek refuge in John U. Lloyd State Park, about 1.5 miles east of the motel," said the paper.

As you might imagine, the law is rarely used. According to the Sun-Sentinel, just 21 arrests were made under the environmental statute between 2008 and 2012.

What is amazing, however, is the severity of the crime - it is a third-degree felony that is punishable by up to five years in prison. Just as one example, in other parts of the country, people who intentionally or actively work to harm the environment get about the same jail time. (http://articles.orlandosentinel.com)

Granted, it was a violation of the law, but...

It's too early to tell if a Florida court will actually sentence Brasfield to that much time but the fact that someone could be thrown in prison for five years for such a low-level environmental crime is difficult to fathom, especially given what seems to be an obvious fact: That Brasfield was not purposefully demonstrating malice or contempt for the law.

And while ignorance of the law is no excuse, we have a little provision of superseding law in American known as the Eight Amendment to the U.S. Constitution, which forbids "cruel and unusual punishment."

Environmental preservation is important, of course, but there are real criminals committing real crimes in America that have dramatically more far-reaching and harmful effects on society than do individuals releasing balloons as a gesture of romance. Shouldn't we save our harshest punishment for the really serious environmental polluters?

when the waste water treatment plants stop dumping untreated waste in the rivers them maybe we could understand getting in trouble for a few balloons .  Here in Richmond down stream from the plant the river has condoms and other flushed items in it , loads of the stuff. One of the guys on a dock we were working on looked in the water and thought the condoms were some plant life in the river as many were covered with green stuff.

Yuuuuuck ! I have a friend that things like that broke him of scuba diving .
At least anywhere near a tributary . Something about brown trout swimming around in what was
supposed to be a pristine area .  :o

From time to time we work on these plants . They employ divers to go into the holding tanks when there is a problem . Sometimes it's in sewage. BIG YUCK. but  very big bucks .

 I for one am very happy to FINALY see someone get what they deserve for littering. I absolutely HATE when people litter in any way shape or form. Releasing balloons is blatent littering.......they're gonna land somewhere.
5 years is a bit excessive but  Fla does indeed have a lot of federaly protected wetlands.I can see thier point. Tho those balloons will most likely land 3 states away.
For the record. Don't even think that i'm a liberal tree hugger.Although, i am indeed a firm supporter of PETA.

Littering is nothing compared to what these illegals do . They will just drop trow behind a bush
and you end up with used toilet paper blown around and into your trees !
Give me balloons any day over that !

So williamlayton, you are saying that that Trooper needs to "get a real life" because he is true to his oath and upholds the law he swore to do so ?
 Or is that Anna needs to "get a real life" because she doesn't like illegal mexicans poopin near her property ?
 Or, is it that i need to "get a real life" because i'm against people littering ?
(by the way, the state of  Pa has a program that allows my family and i to clean up litter from a 2 mile stretch of local road ) ( something i always do on the rural road i  live on also )
 Or, is it all of the above and we all need to " get a real life " ?

Hang on Jim they might be coming to a place near you. The county even put porta potties here and there in town in the hopes they would use them .
They stuffed thier trash in them  :o .
But at least they didn't leave the trash on the side of the road like they usually do.
But its like they say you can't fix stupid . They want it up here just like it was back home .

in all fairness, this weekend mowing
the road frontage of my property, i
picked up a tall kitchen can bag
(what are they? 13 gallons?) of
discarded fast food drink cups,
cig packs, beer and cold drink cans,
juice bottles, etc.
gets tiresome getting off and on the
junky tractor so many times.


there are no border jumpers there.
there may be some hid in the woods some
where, but none living on that dead-end
county road. most likely white-trash
something-or-other word i can't post here.

 I come across these balloons on my hunts occasionally. Maybe 15 or so over the last 20 years. Pretty common it seems in my area near a city and seems harmless enough if a bit unsightly. I've never found a dead critter with a balloon sticking out either end and figure they're a bit smarter than to eat balloons just for the heck of it. I guess in light of everything else happening today a balloon seems inconsequential. Feel bad for the guy hung up legally over such garbage.  J

we have found several weather baloons and one that had a govt address that we don't have a clue about.
