New Jersey police and Dept. of Children and Families officials raided the home of a firearms instructor and demanded to see his guns after he posted a Facebook photo of his 11-year-old son holding a rifle.

“Someone called family services about the photo,” said Evan Nappen, an attorney representing Shawn Moore. “It led to an incredible, heavy-handed raid on his house. They wanted to see his gun safe, his guns and search his house. They even threatened to take his kids.”

“The department has a child abuse hotline for the state of New Jersey and anybody can make a call to that hotline,” spokesperson Kristen Brown said. “We are required to follow up on every single allegation that comes into the central registry.”
Moore, of Carneys Point, is a certified firearms instructor for the National Rifle Association, an NRA range safety officer and a New Jersey hunter education instructor.
He recently posted a photograph of his son wearing camouflage and holding his new .22 rifle. The child has a New Jersey hunting license and recently passed the state’s hunter safety course.
“If you look at the picture, his finger isn’t even on the trigger – which is proper,” Nappen told Fox News. “If half of Hollywood could follow that rule we’d be thankful.”
Brown said their role is not to go out and search Facebook for photos of children holding weapons.
“In general our role is to investigate allegations of child abuse and neglect,” she said.
The family’s trouble started Saturday night when Moore received an urgent text message from his wife. The Carneys Point Police Dept. and the New Jersey Dept. of Children and Families had raided their home.
Moore immediately called Nappen and rushed home to find officers demanding to check his guns and his gun safe.
Instead, he handed the cell phone to one of the officers – so they could speak with Nappen.
“If you have a warrant, you’re coming in,” Nappen told the officers. “If you don’t, then you’re not. That’s what privacy is all about.”
With his attorney on speaker phone, Moore instructed the officers to leave his home.
“I was told I was being unreasonable and that I was acting suspicious because I wouldn’t open my safe,” Moore wrote on the Delaware Open Carry website. “They told me they were going to get a search warrant. “”We said no way, it’s not happening,” he said. “This is a guy who is completely credentialed and his son is also credentialed.”
The attorney said police eventually left and never returned.
“He has a Fourth Amendment right and he’s not going to give up his Fourth Amendment right or his Second Amendment right,” he said. “They didn’t have a warrant – so see you later.”
Brown told Fox News that it’s “prudent and wise to protect children.”
“In many cases we may follow up on something and we don’t find any problems and the case is closed,” she said.
But the person who reported the false allegations of abuse cannot be held liable, she noted.
“You can’t be prosecuted for making an allegation of child abuse –even if it’s false,” she said.
Nappen said what happened to the Moore family should serve as a warning to gun owners across the nation.
“To make someone go through this because he posted a picture of his son with a .22 rifle on his Facebook page is pretty outrageous,” he said. “Does that mean that anyone who posts a picture like that has to consent to a home inspection and a gun inspection? I don’t think so.”
Nappen said they are considering taking legal action against the state for the late night raid.
The story of David & Goliath only demonstrates the superiority of ballistic projectiles over hand weapons, poor old Goliath never had a chance.

I don't do face"boob", too many idiots there! I have instructed my wife to not let any LEO's  into the house unless they have a warrant. She will not answer the door if she doesn't know who is there, anyway. We live out in the boonies.  Last week, someone knocked at the door twice after dark while I was gone. My wife didn't see a vehicle leave or anyone around the house, so we don't know who it was. I have installed two trail cameras since then.

Another example of overreacting and heavy-handed by both the protective services agency AND the police.
 
Yes, the protective services agency is required to investigate any and all reports, even if anonymous, of possible child neglect/abuse/endangerment.  But, a picture of a kid holding a rifle hardly justifies a small army of police showing up at the door.  And once there they apparently decided to try to go way beyond just investigating the welfare of a child.
 
Mr. Moore's actions are a model for anyone to follow if ever in a similar situation.  Remain calm, be polite but firm, don't give permission for ANYTHING, if asked any questions just say you want to speak to an attorney. 
His only mistake was posting the picture of his kid on facebook.  Not only does it give the "anti's" a chance to make your life miserable it's also out there for any other sicko to view.

NJ is a very hazardous place for gunowners... just ask Brian Aitken.


Dad did the right thing. As for DYFS... they're typical NJ gov't drones. I did some IT work for them a few years ago. I learned something of the thugishness of state gov't, and LE there. It's ugly.
Jesus said we should treat other as we'd want to be treated... and he didn't qualify that by their party affiliation, race, or even if they're of diff religion.

  I got persuaded to join in to "Faceboob" but very rarely go there..and then only to observe, not comment or add any photos..  ..Because I don't really care if little Angus ate his cereal this morning or if Aunt mary had a bowel movement yesterday morning.
 
   That being said, I hope this guy takes these cops to court and gets them (or their boss) fired. 
     Any police dept worthy of the  name.. should have asked CPS  "Where's your search warant?".. long before they began to encroach upon this man's life and property..

In Wisconsin a child protection worker has no authority to enter the child's home following receipt of a child abuse or neglect report which was accepted for investigation.  If there is present danger to the child, an officer can enter the home without a warrant, otherwise if the parent refuses access to the child, the officer has the option to take the child into his custody so the interview with the child can take place.
 
The child protection worker is allowed to access the child at his or her school without the parents knowledge or permission and without anyone else present in the room where the child is being interviewed.  If the parent interferes at the school, they will likely find themselves in a private room at the Graybar Hotel.
 
The name of the person who reports the child abuse/neglect is confidential.  If the report is malicious and without merit the reporter can be fined and/or incarcerated if I remember correctly.   This is how I remember these situations and laws and they may have changed.  They are generally state laws so they vary from state to state.   
Vote them all out, EVERY election!
 
Does anyone remember the scene from "Quigley Down Under" showing the aborigines lined up on the skyline as far as you could see?   That needs to be US!

All people involved in this atrocity of law enforcement ought to have their names and pictures posted so everyone can see those who have no regard for our Constitutional rights. Too much power concentrated in the hands of  governmental (state, local, and federal ) idiots. Something like this could just be the spark that is going to take blaze on the road to take our country back.

  I have long been upset with such sneaky rules.  According to the constitution, a person should have the right to confront his accuser!  Nobody should be allowed to accuse anonymously..
  Then too, we all know a child when left in the hands of an unscrupulous professional, can be manipulted to accuse anyone of anything..  I sure hope some parent treated in this way has funds enough to insist upon his/her constitutional rights ..supposedly guaranteed by article #6, Bill of rights..

In Wisconsin, proceedings under Chapter 48, the Children's Code,  are not criminal.  The state has no jurisdiction over adults under Chapter 48, only children.  If a parent hurts the child,  I believe the state can start proceedings under criminal law.   I believe that gets us to Chapter 948.  As I said, I have been retired from that work for over ten years.  The system is not perfect.

The police told them when they refused to open the gun safe that they were acting unreasonable and suspicious!

If anyone really believes that the LEOs will not come after you and your guns if given the order.
