I wouldn't charge him.  And im no fan of removing thought from any situation.   Just commenting on how some fell in love with the, "we have to follow the law" line of reasoning when it fit their agenda.

Some would be plural, seems I was singled out! but I have no agenda.(well that is not true) I don't agree with the drug war or persecuting (not a mistake) this kid. It is I suppose my fault for not making that clear.   
 
 
 The law in both cases should be changed/modified in the attempt to be reasonable.

So if the law on the books says he must be expelled we should or should not follow that law?  I'm just trying to get a feeling for when it's ok to ignore a law and when it's not?

 
DUK. As a lawyer you know that right and wrong or common sense have nothing to do with legal. What about intent?? His biggest mistake was trusting liberal adults to do the right thing, problem is that liberals don't KNOW what the right thing is. I hope he finishes school and the morons drop charges, an apology for them being jerks is in order too. POWDERMAN.

There are very few laws on the books in which an officer must arrest for. In good old California the officer must arrest for dueling and failure to disperse the rest are up to the officer. There is such thing as officer discretion. The officer may be committing career suicide but still has a lot of discretion.
