This month, the U.S. Court of Appeals for the Sixth Circuit issued an 8-8 ruling in our bump stock case against the ATF, resulting in the ruling of the lower district court by default.
The Sixth Circuit Court failed to answer our question as to whether unelected bureaucrats at the ATF have the power to create new federal crimes out of thin air.
Because this question is too critical to leave unanswered, GOA is already preparing a petition for certiorari to take this matter to the Supreme Court.

The implications of this court case go far beyond bump stocks.
At its core, this case is about whether the ATF has the authority to bypass Congress and establish its own rules concerning the Second Amendment.
If the ATF’s ban on bump stocks is upheld, the road will be paved for a ban on AR-15s and other similar firearms.
And it won’t stop there…
...The ATF will essentially be granted the authority to continue bypassing Congress on any matter it pleases under the guidance of the most rabidly anti-gun executive branch in history.
In fact, we’ve already seen the ATF’s proposed rules on homemade firearms, or what they pejoratively call “ghost guns.”
On top of that, the ATF is seeking to ban as many as 40,000,000 braced-firearms.
The Supreme Court is our only hope of shutting down the ATF’s slippery slope to tyranny.
If unelected bureaucrats can grant themselves the power to deem U.S. citizens felons overnight, then we will no longer be living in a free country.
