Soon legal for Texans to have handguns in cars
07:24 PM CDT on Wednesday, August 24, 2005

From 11 News Staff Reports

It may come as a surprise to some that starting next month Texans will be

allowed to carry handguns in their cars.

Since 1871, carrying a handgun has been illegal in Texas unless the owner had

a permit or could prove they were traveling. This created confusion since

traveling was never defined.

Texas lawmakers cleared up the confusion in their last session by defining it

as driving a private motor vehicle.

This means starting September 1, anyone can drive around with a handgun in

their car without a permit. That is as long as they are at least 21 and meet

other criteria like not being a gang member. The gun must also be out of

sight.

Some law enforcement officials say they fear the law may lead to more gun

violence.

Great law, I think all States should have the same law.  :D

In Mississippi, a private vehicle is considered "an extension of your home" and any firearm that is legal in your home is legal in your vehicle.
I don't think it has to be out of sight though low profile is likely a good thing.

Well, here we go again. Texas!
I really would suspect, the whole of Texas being considered, that there are/have always been a whole mess of folks with weapons of some breed in the glove compartment, permits(which are a relative new thing to this world-well, er, Texas) or no permits.
The law has always pretty well defined when and how folks could legally carry a weapon. straight line, over two counties, no side trips or stops.
Now the rub. The boys, in Texis (spelled as pronounced-by golly) have always taken a dim view of Austin telling them how to run their county/counties. The big towns were about the same but they have taken too being a little tighter on the reigns than other places.
Got a friend, down Corpus Christi way, in a county sheriff's department who has a gun, super .38, that was given to him by a nephew of George Parr (weapon was actually George's originally). Now this old boy was a convicted felon and he brought it to Bill, as a gift, in a paper sack laying on the back seat of the car. This deputy sheriff filed no paper on Mr. Parr's nephew, just took the weapon and thanked him. Weapon is very nice, has Mexican gold and silver grips on a light weight commander with some Mexican engraving. Weapon has been well shot, has George's initials on the grips.
I digress. It  was a point of the conversation that this was very illegal and Bill's opinion that it was only illegal if you got caught. Really, the boys around here do not go looking if everything looks ok.
As a matter of fact, the reason the conversation came up, was because of a traffic stop the night of the conversation.
Bill's wife was driving their Suburban and we were following. We had been out to eat (is drinking needed to be explained also) at a resturant out of Robstown (a good atlas is needed to follow this story-find Corpus and look to the S/W.) on Baffin Bay. This area is heavily patrolled by the State Boys and Shriff's in the area due to Illegals traffic. Bill's wife was driving, that was good cause Bill was not in a condition, well, ya know. The stop was made because of the number of folks in the Suburban-We had about 15 folks in two vehicles-Suburban and Tahoe. Bills wife handed the Trooper her DL and CHL. The trooper asked if she had the weapon on her and she said NO but her husband had two. The Trooper asked if anyone else had a weapon and Bill's wife said she did not know. We had pulled to a stop when she was pulled over, he never came to our vehicle. He did say something about the reason he stopped her was because of the number of folks in the vehicle. He took a cursory look in the vehicle, meanwhile everbody was hiding the paper cups, said for her to be careful and try not to have so many people in the car the next time. Some of the folks in her car was pretty big folks and it was a tight fit for everyone. Trooper said thanks and go on home. He never did ask Bill for any ID.
All that to say this, things can be a little different here in Texas.
Blessings

:D williamlayton.  Ah, com on, things are not different here in Texas, it's the rest of the world that is different.

For the sake of some folks I am glad to see the law changed to allow carry in your vehicle.  I have never backed away from packing a pistol with me anywhere I travel.  I have had concerns about traveling around the big cities like Dallas San Antonio, or Houston with a loaded weapon on the seat next to me.  When I checked into a motel, I wondered, "Do I leave the gun in my room?"  What if the maid takes it and her gang banger son uses it for a hold up?  So many ifs, ands and buts, It was always my choice to take the chance, and carry it with me.  As we all know,  some of the big city cops are rather narrow minded and frown on an outsider running round their city with a gun, if caught you are at their mercy.  It does seem the small town cops are more understanding.

Since the CHL law was passed I have been legal, but the new law will provide some of the honest, law abiding folks the opportunity to pack while traveling without fear, and they won't have to get a CHL. I am all for it!

Would it be true then that Austin has only recognized what has been common law forever, here in Texas, anyway. AH Austin! Nothing new under the sun but things forgotten.

 Austin?  I left that jewel out, are they still part of the state?  Lucky I guess, but I have never had a problem while there.  I talked to one guy that said ever time he goes to Austin the locals know before he arrives and are waiting at the city limits to pull him over.  He said he had been stopped and detained several times after producing his DL, Insurance and CHL to check his firearm to see if it were legal, etc.  Sounds like he gave the cops a hard time for stopping him and they just flexed their mussel a bit.  I understand that, I the same problem in Warner Robbins, Ga several years ago.  Hell, I didn't know the young lady I was with was the Chief of Police's girlfriend.  He didn't take too kindly to her being in my car.  I asked to be sent to Vietnam to get away from there.

I do believe that it works as proved in Flordia where only the cars with rental plates were targeted for robbery & such.

Around here, seems like a lot of Women want this bill to pass. These are even nurses whom are getting off work on 2nd shift or going in on midnights.
The police are just not avalible to protect everyone all the time.
