Some counties taking steps against allowing rifles......
« on: September 30, 2005, 11:16:18 AM »
Stopped at a local gun shop, and one of the employees, that lives in Schoharie County, told me that the county almost has enough votes to pass a local ordinance to restrict the use of rifles in the county.

Anyone else out there hear anything about this subject in any of the counties involved in the recent law that passed.

Thanks, Joe

Haven't heard. Wouldn't surprise me though. Common sense doesn't always win out against stubborn political traditions, PC, and folks that have little if any knowledge of the topic. Bumped into a fellow the other day that said all the land his group hunts will be rifle free. That is what they decided. Fine that's their choice. However after our little chat he walked away realizing how ludicrous it was. The large area I have a permit for won't allow rifles because of "safety issues". Mostly thick hardwoods by the way. My nephew will be allowed his 270 Encore scoped handgun, but I can't use my peep-sighted 30/30. Go figure!!! Like I said, common sense doesn't always win.

I was thinking about using a paint ball gun with a video camera attached. That way I can record my kill, the other hunters will be safe, I'll be safe, and everyone is PC happy!! But if paint balls aren't good for the enviorment I may have to find a nerf gun. I'll just have to pick up the nerf bullet when I leave.

Oh boy...They'll arrest you for harrassing the wild life...So, instead of killing a deer you will be marking it for another hunting to hit.

BTW, paintballs are water soluble and post no hazard.  There will be no evidence of your crime after one rain shower.  :D

I have also been hearing rumors about some farmers not allowing rifles on their land either. Again that is their right to do so. I just may trade two Mod 94's in on a T/C Encore .50 cal. in-line and cover ALL bases. Later, if things "cool down" I can always get a rifle barrel.

This comes up in PA almost every season. We have lots of case law ruling that if the game code allows it the local government can't stop it!  You just have to stay outside of all safety zones. Property owns can restict it!

That sounds like an outstanding plan. I have an Encore 209x50 and so far just a heavy bbl 223. I want to see how this whole rifle deal pans out myself, if it seems worth it I'll probrably invest in a 308 win bbl for my Encore for next season. I have a 6mm Rem I could use this year if I choose. Although my rifled bbl 1187 and my Encore  have served me well in the area I hunt.

Montgomery County was also considering such an ordinance but I don't know how far it has gone.  One obstacle the ordinance faced was that in a more publically crowded area in Shenectady County, the Glen Sanders Preserve located in Scotia, the town continues to allow smallbore rifle hunting.  Montgomery County is not all that populated and there are a lot of areas that can easily handle rifle hunting.

Individual landowners have al lthe right they need to set whatever limitations they want on hunting their property, including prohibiting it.  Mikey.

whats the big deal boys. we have been hunting with rifles in greene and deleware as well as parts of schoharie for years. what is the differance from one side of the road to the other. no matter what firearm we choose we have to be responsable for our shots. we all took the same hunter safty course. also been able to hunt chucks with a rifle in shotgun counties for years. seems like we should be alowed to use the best we can use. take my long gun any day of the week. shotguns were ment for small game as far as i am conserned!!

The way I understand the regs. rifle hunting has always been legal in all NYS counties for  hunting, but not during deer season where firearm restrictions take presedent.  In other words, I can use my 30/06 the day before & after deer season in Schenectady county for coyotes, but not for deer & not during deer season.

rebAL - you just might be right about that.  I hunt coyote in Schenectady County just that way and it is legal.  Time for me to go back and re-check the regs.  Mikey.

Question For rebAL and Mikey
« Reply #12 on: October 25, 2005, 04:42:27 PM »
I agree with rebAL but.  What "deer" season are the regs referring to, i.e. gun season; early archery, or what?  Night time is referenced, but what about hunting during the daylight hours?  I have soured the regs, and it does not specify which deer season, nor mention anything about daylight hunting.  Did I miss something in the regs?

I, too, am in Schenectady county, and have fired off an email to the local ECO Lt., and am awaiting an answer, as he was on vacation last week.

I have two reasons for asking.  (1) I want to know for my own benefit, and (2) I teach Hunter Safety, and do not want to mislead the students, when asked about this growing sport.

It (the regs) is pretty clear, as to after deer season, but what about the early bow season down here in the Southern zone?  Can one hunt yotes during the day with a centerfire gun (pistol/rifle) during the early bow season?  Inquiring minds want to know.

I don't believe you can "Be afield" with centerfire rifle during deer season in Southern zone; nor have a light bigger than penlight type flashlight  I believe shotgun, M/L, archery, & handgun are all OK;   I don't think you can be afield with handgun during archery & M/L season; OK during firearm season.

the yottie season starts the 1st of october and you can hunt them with any firearm shotgun/ centerfire. yes archery season is open but if you are just hunting yotties thats fine.there is nothing stating you cant use a centerfire just because archery season is open. the law states you can not  carry any firearm while engaging in archery hunting or be with anyone carrying. it stated you could not carry a centerfire in shotgun only aresa during the open firearm season. we all know the reason for this a fella would be out deer hunting with his 30-06 in shotgun only areas during the firearm season and give the old i am yottie hunting excuse.

When I lived in Onondaga Co., I could hunt wood-chucks with a .270 Win., but had to hunt Deer with a shotgun. Go figure. One of the reasons I don't live there anymore. Mack
