US Border Patrol Agents Prosecuted by US Government

Two nations are threatening American law-enforcement officers who protect this republic's southern border. Mexico is the obvious threat. The other will stun you.
Men dressed as Mexican soldiers have set foot on American soil mo! re than 200 times in the last decade. The Mexican government claims they are impersonators helping drug warlords' shipping into the United States. Whether soldiers or soldiers of fortune, Mexico has done virtually nothing to stop incursions by heavily armed forces in military-style Humvees.
Mexico's inaction surely has helped embolden drug warlords salivating to crack the U.S. market. Hudspeth County, Texas, is just east of El Paso along the Mexican border. The sheriff's department has heard that drug dealers have put bounties as high as $10,000 on the deputies' heads -- and threatened their wives and children. That would explain the armed guards at the schools their children attend.
What is inexplicable is that the other country targeting our law enforcement border agents is the United States.
Border Patrol agents Jose Alonso Compean and Ignacio Ramos shot Osvaldo Aldrete Davila, an illegal alien and admitted drug smuggler, in the buttocks in Februar! y 2005, according to the El Paso Times. Mr. Davila claims he was not armed. The agents say he was. They did not report the shooting but did report that the van Davila was driving to an El Paso stash house had 700 pounds of marijuana.
The Department of Homeland Security should have sent medals to each agent.
Instead, it sent an investigator from its Office of Inspector General. He concluded that since Davila was escaping back to Mexico, the agents should not have fired. And since they picked up their shell casings, that supposedly made it a cover-up.
A federal grand jury in April charged the agents with assault with intent to commit murder, assault with serious bodily injury, and assault with a deadly weapon -- potentially 40 years in federal prison.
It gets worse.
Mr. Davila was offered immunity on the drug charge in exchange for his cooperation to help convict the Border Patrol agents. And the investigator arranged for Davila -! - a Mexican national in the drug trade who sneaked into America illegally -- to be treated alongside American military personnel and their family members at the William Beaumont Army Medical Center, so his urethra could be rebuilt.
It gets worse still.
U.S. District Judge Kathleen Cardone recently granted a request by the U.S. attorney prosecuting the agents to exclude any mention of violence along the Mexican border, and in particular, the violence and death threats from the drug dealers targeting Hudspeth County.
And so mum's the word about the convoy of SUVs that had been hauling about 2,000 pounds of marijuana before it broke down in Hudspeth near a Mexican border lined with military Humvees to protect their fellow smugglers.
Surely Homeland Security will recommend several outstanding plaintiff attorneys for Davila so he could sue the federal government -- and the agents individually -- for his pain, suffering and whatnot.
And ! after Davila pockets whatever amount a civil court jury might award to supposedly make him whole, the only thing left for Homeland Security would be to organize his "welcome home" parade.
Perhaps Mr. Davila could recommend a good mariachi band.

The article has a lot of problems with it. I don't think I'd accept it at face value.

Had this been on Mexicos southern border , the army would have not stopped shooting till they knew that the guy was dead and that would have been the end of the story .

I have family that live in El Pass On Over as they call it , illegals and drugs flow like water across our border and the Fed. goverment has no will to stop it .

I do not give a hoot if these agents picked up their brass or not , what bothers me is that the feds would make a deal with a convicted drug runner and treat him in an american hosp. while putting the men that tried to stop him on trial .

One thing really doesn't have much to do with the other. We don't let people bleed out on the ground because they are criminals. Or drug addicts. Or people we don't like. It isn't our way.

The grand jury wasn't asked to dispense justice, it was asked whether there was a reasonable suspicion that a crime had been committed. They said yes. They weren't asked to weigh the comparative worth of the drug dealer over the federal agent. They were asked a specific question and answered it.

The men that are tasked with stopping guys like the drug dealer are also expected to do so within the law. It is now up to a court to determine if they did. If it were me, I'd wait until the verdict before saying an injustice had occurred.

We don't know if the Border Agents committed any crimes. That's what a trial is about.

First genocide, now individual murder. Any form of killing you don't approve of?

powderman, a grand jury looking at the evidence thought otherwise. That, in my county, means at least 16 out of 25 people considered the evidence and said there is a reasonable suspicion a law had been broken.

You, having never seen any of the evidence, conclude that no law has been broken. Why? Because you apparently think that people you don't like don't deserve the same protection of the law as people you do like.

That makes the conservative intonement about how "we are a nation of laws" a lie, doesn't it? Laws are for those we like, apparently.

Are you maybe a Bolshevik? That's the reasoning they used. They also ignored the laws when they felt like it. It sounds very similar to what you are saying, so are you a Bolshevik, Powderman? If not, maybe you should quit talking like one. When supporting the law is the "wrong side", then maybe I'm speaking to a Commie. They don't like laws, either.

Our borders should be vigorously defended, to the point of death if necessary. I'm sick of hearing about undocumented workers, they are invaders, and should be treated as such. We don't just up and kill people that are criminals. We bring them to trial and let the laws do their work. If the cops shot an unarmed man, they broke the law. No one is above the law and no one should take the law into their own hands.

Why are you standing up for possible criminal behavior by people who took an oath to enforce the law, not deliver "on the spot" justice? Absolutely, the illegal aliens should be captured, prosecuted, ajudicated, etc. That is a job for the courts. The cops are supposed to catch them, not execute them as you seem to think they should. You been watching too many Dirty Harry movies or something?

The law is all we have that keeps us from becoming a dictatorship. Yet here you are, willing to allow border police to dispense summary justice because you don't like the people they have to deal with. Well, that isn't their job. Their job is to catch the bad guys, not execute them. When someone breaks the law, they become a criminal no matter who they are or in what cause they serve. If the border agents broke the law, they should stand trial, the same as EVERYONE.

When the Republicans made solemn intonements about how Clinton should have to answer to the law for his misdeeds, I agreed. No one is above the law. Now, however, we find that for powderman, that principle was for people he doesn't like. People he does like, they don't have to worry about breaking the law. He'll cover for them.

He drove a van with 700 lbs. of drugs which is a fact but how did he get shot? It would appear at face value that they tried to cover up the shooting but if it was a "good shooting" thus justified why not just record it and go on with proper procedures?  Just too many to questions about the behavior of the border police. What are the laws concerning firing at a fleeing suspect--is shooting some one in the back legal, in this case in his butt?  I certainly do not think the courts should over look the suspect's involvement with the 700lbs. of drugs. Two wrongs do not make a right and the ends do not justify the means. The suspect should be tried for the drug charges and the shooting should be investigated.  If the border police broke the law in shooting the fleeing suspect then they should face the music.

GUYS. IF, and I do mean IF, the border agents did anything wrong it was probably because they are frustrated with seeing these scum slapped gently on the wrist and turned loose to do it all over again. The punisment for these invaders should be so severe that they will NEVER chance it again, if that means some of them dying, it's their choice. Run drugs and die, I have no problem with that, it should be their choice. Catch a drug runner, execute him on the spot. No reason to waste taxpayers money, uhhhhh, unless it's nabobs. There would be a drastic reduction in the flow of drugs. How many lives would be saved???? I bet a lot because the supply would be greatly reduced.

Cops catch criminals, the courts decide punishment. When the cops start doing the court's job, it is time to punish the cops. If the cops here broke the law, they have joined the criminals. I dunno if they've broken the law. That's what a trial is for.

That's how we do things in America. No one is above the law, not even the police. And the good ones (which I tend to think represent the vast majority) would say the same thing. No one is above the law.

What sparson said +1. I have to wonder why they policed up their brass and did not report the shooting. Now, I need to say up front that I have ZERO problem shooting armed drug smugglers crossing into our country illegally. But something about the story doesn't seem right. If it's a clean shoot, great! Give 'em a medal. But if it's not, they need to be tried in a court to see if any laws have been broken. That still doesn't change the fact that our government is slobbering all over a known criminal. The bad part to all this is the smuggler lived.
Not all Muslims are terrorist, but oddly enough, all terrorist are Muslims.
