Got me thinking - guns after death
« on: April 15, 2007, 10:19:52 AM »
One of the posts got me to thinking , what would you guys do with your guns if you would die , myself have a picture log with all my guns with a $$ amount that they should sell for . that is just one less thing for Mama to have to worry about .

I keep a copy at a safe depot box as well in case of fire or other nat. disaster for ins. claims .

I've been doing some thinking along the same lines, have an older brother that they gave 5 years to live 7 years ago.Only have one yonger brother left and he is not into guns or hunting. Will leave most to him to sell, but have been thinking lately of leaving a couple to good freinds or their kids.

My sleepless nights ended on Nov 20th, 2006.  My son blessed me with my first grandchild!  I will be leaving my guns to him but.......... I have no intention of leaving anytime soon!!

The wife knows there is a list in the gun safe telling about everything.  If something happens to me earleir than I plan on, she is to give a couple of them to individuals.  The rest she can take to an honest gun shop nearby that consigns.  Hopefully she will get enough to pay off something.

Won't be a problem here- I have two sons and one grandson by each so they will split them up.  My newest grandson will be a year old next month and I showed him "his" Pardner the other day!

It's call a Will and you should have one. You can always donate them to Delta Waterfowl or a group like that.

I want to urge you fellows to put these things down in writing.  While we would all like to trust our loved ones to know what to do, it will make things easier for them if you do have it down.  I've been through this a few times with grandfathers and my own Dad's guns and there are still hard feelings over things that happened 30 years ago.  Grandma gave so and so grandpa's rifle and everyone knew it was supposed to belong to the other one (that sort of thing).  Be specific and put in down in writing with your will.  Do everyone you love a favor and include a description, serial numbers and picture.  Some of you have quite a few handi's (QUICK) and not everyone in your family might know the difference between a Buffalo Classic and a Topper.  Just my 2 cents.

I have impressed on my children to have a will as soon as they are 18. I lost two sons at age 6 and 28. The 28 year old had a will and over a dozen guns. Thanks to the will , New York State could not step in and take over. He kept receipts with each one. I do the same. Depending where you live a will is absolutely necessary. There are more ways to lose our guns than to keep them. Be Prepared.

I think firearms are some of the best heirlooms that could be had.  My brother is where I got most of my collection, minus the handi and some other minor stuff.  We also have some old rifles and muzzle loaders  that are my fathers and go back to his grandfather. My brother passed 5 years ago and everything went to my parents, no children or wife for him.  The guns became a share collection for me and my brother. I keep my handi, the ruger bolt .22lr,  one of the shotguns, my AR and a .32 tomcat in my cabinet at the house.  The rest are kept in his old safe since my other brother bought his house when he died.  It is a pretty big Fort Knox weighs over 1000 pds, that is air tight and fire proof to just below 2000 degrees.  I guess if that isn't enough to protect them then so be it.  He kept all his receipts and details in the safe as well.  I guess it is down to me and my other brother to have someone to leave them to.  If I never have that, than I guess I don't really give a damn what happens when I am dead in gone.

Anyone have any experience with the online will/legal services vs. going to lawyer or something like that?

I know that the living wills you get at the hospital are supposed to be legal as long as you have two witnesses that aren't family members sign it, but those really don't have anything to do with property.

Any one that suggested getting a will is absolutely right. My Dad died a few years back and even though it was a pretty simple estate no will made it more complicated than it needed to be. Guns being great heirlooms is right on the money too. After his body left the house the only things I took from the house that day were the guns. All of my guns will go to my sons and maybe one or two to a life long friend. I need to make a list of who gets what. Thanks for getting me thinking about this Stimpy. I hope it's a long wait for my sons but one never knows. I thought this was a thread about will there be guns in Heaven. If so I hope to get back that old 20ga Topper my second wife pawned.

Like a lot of you, I have a list (spreadsheet) showing what I have and where it came from and what I gave for it.  I also have a column as to which of my children get what.  I don't want them to have to make that decision.

My father-in-law started to give my children a firearm when they turned 16yo.  He passed away after 2 of them received their present from grandpa.  No one had any idea what he owned or where it was in his house.  When we went through the house we found a loaded pistol under the mattress.  A loaded .22 in the upstairs bedroom.  Some boxes of shells that we never did find a firearm that they fit.  We even found a WW II grenade, which we had the local bomb squad check out.  The powder and primer had been removed and it was reassembled.  They only let us keep it if we drilled a hole in it.  But we did find enough firearms so that each of the grandchildren got one.  All were given with a couple of restrictions.  First, they had to be used with adult supervision until they were old enough.  Second, they had to stay in the family.  If they didn't want it or felt that they needed some money for it, they had to first offer it to me or one of their siblings.  Then if no one wanted it, they were free to do what they wanted with it.

Probably half the guns I have stored at my place belong to the kids.  My wife knows where the list is kept (in the gun safe) and the kids know of it's existence.

I agree, take the time and make some provision for these items to be handed down.  It isn't really the item that is important, but the times that they represent and the memories they will bring back..  I remember the times I went shooting with my dad's old single shot .22 along the river bank.

Well I guess I should thank you guys for making me think about something this important. I am only 27 so I have never really thought about it much before, but with my line of work it might be a good idea to think about making out a will. God knows I wouldn't want the government to get my guns! >:( Now I just have to figure out who to leave them to. That's not easy!

I've got a son due this week.  I'll leave all mine to him.  One special one is an old 16 ga. single shot my Grandpa bought after he got home from Korea to shoot rabbits off his farm.  He gave it to my dad, who gave it to me a few years ago.  I got it cleaned up and working properly and shoot it once in a while.  It's not worth anything.  Just a family heirloom.  I wanted to buy the new little guy a .22/.410 Versa Pack.  My wife says I have to wait a few years.  I told her that I'd be happy to shoot it until he's old enough. ;D

Wills - guns after death
« Reply #21 on: April 18, 2007, 12:39:54 PM »
Hello to the group,
I am not a lawyer, but as far as I know a will needs to be entirely hand written or filed with an attorney to be valid.  I can not speak for Louisiana, Napoleonic law.

I am covered as I have a trust.  The trust owns almost everything.  I will state in a letter that the trust owns my firearms.  It is ideal if I ever get a class III firearm, the trust will file the forms and buy the firearm.  With no fingerprinting, mug shots or LEO sign off necessary.

Thanks,
Paul

There are numerous online will options in addition to software, no reason not to make one. Those listed below are recommended by Clark Howard. ;)

Tim,

I should have known that you would say something along those lines. Unfortunately I only have one handi so I don't know that you would be too interested in the collection. ;)

Tim,

How about we wait until I can get the time to get some more barrels for it and a new stock and then we can talk about who gets it. I just couldn't bear the thought of leaving my plain jane handi to you or Stimpy and you guys fix it all up and make it looking good and I couldn't see it. That just wouldn't be cool!  8)

After you are dead it won't really matter to you what happens to that cabinet full of machines, (they are just machines even though people give them names and other attributes)  if you want to do something that matters to you and makes you feel good, do it before you are dead.  Larry

Good point!  Maybe if we have someone in mind, we should give some of those guns to them now and actually enjoy seeing them use them.  Take a kid hunting.
