A SHOOTING

Here are the facts as I know them---it has been two weeks now.
A neighbor of a man, in a subdivision near me, saw two men breaking into this neighbors house.
The man called 911. Reported the incident. He told the 911 operator that he was going to get his gun an shoot them--I think an irrational statement under heat/stress--and the operator told him to stay put---the calvary is coming.
The man got his shotgun and the next thing we know is---he is still on the phone with 911--him telling someone to stop---then two shots.
Both of the burglars are dead---buckshot wounds.
The Harris County DA---who loves to fry-- is having a hard time making a decision on any charges too be filed.
This is pushing the envelope in Texas even. The law is designed too allow a neighbor too protect a neighbor---but it seems that you must be asked too do so---I still can't figger that out in my head---but would assume request is implied.
The BG's-- WERE-- in the yard of the one doing the shooting, as I understand it.
Both burglars were illegals from South America. The "fiance" of one of the burglars wants the neigbor too go to jail. Why is a girlfriend always a fiance??--if I may ask!
Quanell X is mediating and is on the side of the BG's.
The shooting neighbor is having a hard time with the shooting and is very depressed.

IMO the DA is having a hard time with it because the Castle Doctrine says you are authorized to use deadly force to protect life and property.  If so, the perps being in his yard certainly constituted trespassing and if he yelled at them to stop - did they turn and attack or were they in the act of fleeing?  It's difficult to say without knowing all the facts.

Acts like these should be sending the message to would-be thief's that stealing from someones home is most certainly a deadly proposition.  In these days where criminals are more brazen I'm glad we have this authority that also shields us from civil action for wrongful death.  It always made me sick to hear of some poor fellow that was simply protecting life and property being sued for wrongful death by the perps family.  I hope everything works out for him.

Let me clear some confusion.
This man--61 years old--defended. He did not start the incident. He defended his neighbors, his community, his county and his state---he is not the criminal and he did not commit a criminal act--he killed a couple of good for nothing and, worth less than the shells cost too kill them, thieves/criminal/scum, and their families should have to repay the cost of them.  breath deeply!!
The general consensus among the police is that the outcome will be alright and that the man was trying too do the right thing.
