Supreme Court ruling?
« on: February 06, 2008, 04:30:27 AM »
Has anyone seen or heard anything about the Supreme Court ruling on the second amendment? I've tried to stay alert on this by watching the NRA news on the net but, haven't seen much, recently?

Aside from some amicus briefs filed by interested and disinterested parties, the nine on the line haven't rendered anything public yet.

I don't think a decision is expected before May or June.

These Congressmen signed to limit your firearms rights.  They are up for reelection.  Whether or not they win, is up to you.  If you are a paid member of these organizations and get their literature, is up to you whether to continue such and aid the finance in taking away your inherent rights.  It is up to you whether or not to submit letters or emails demanding these institutions restrict their opinions to actual policy at hand and not politically correct opinions.  As you can see, there are lots of organizations, police forces, cities, states, Congressmen, US Solicitor General of the US, college professors and medical profession are all in support of taking away our firearms rights in the name of violence, child safety, civil obedience, or some other trumped up claims.  Stay complacent or do something now.  Where is the NRA, GOA, other States amicus briefs in support of Heller, protests agaist these organizations using its authority to change fundamental rights by use of its membership, and massive indignation to these members of Congress for ignoring their oath of office to support the Constitution.  Don't bit** and complain after the fact.  I've written our Governor and requested Alaska submit an amicus brief in support of Heller and it appears from Statewide news that this is indeed going to happen.  What about the pride in your State, can you say the same and or do nothing?

By the way, the States Congressmen who signed in opposition of Heller have the following State Constitution's for a guide which was ignored entirely.

PA
Quote
The right of the citizens to bear arms in defence of them selves and the State shall not be questioned
So much for PA' s Congressmen oaths of office.

MI
Quote
Every person has a right to keep and bear arms for the defense of himself and the state

IL
Quote
Subject only to the police power, the right of the individual citizen to keep and bear arms shall not be infringed

MN
Quote
No provisions

CA
Quote
No provisions

TX
Quote
Every citizen shall have the right to keep and bear arms in the lawful defense of himself or the State; but the Legislature shall have power by law, to regulate the wearing of arms with a view to prevent crime

AZ
Quote
The right of the individual citizen to bear arms in defense of himself or the State shall not be impaired, but nothing in this section shall be construed as authorizing individuals or corporations to organize, maintain, or employ an armed body of men

NY
Quote
  No provisions

WI
Quote
The people have the right to keep and bear arms for security, defense, hunting, recreation or any other lawful purpose

VA
Quote
That a well regulated militia, composed of the body of the people, trained to arms, is the natural, and safe defense of a free state, therefore, the right of the people to keep and bear arms shall not be infrinded; that standing armies, in time of peace, should be avoided as dangerous to liberty; and that in all cases the military should be under strict subordination to, and governed by, the civil power

MD
Quote
  No provisions

DC  (I personall disregard any provision as unlawful according the US Constitution.)

I think from these States Constitutional Law, it is extremely clear that the majority of them clearly indicate an individual right to firearms ownership.  So, any Congressman who supports D.C.'s legal position contrary to the above is in violation of his own states law regarding legal firearms possession and these same people enact laws governing the rest of the country.  They should be removed from office by their own constituency.  Most of these Congressmen should be impeached for violation of oath of office.

According to the schedule, the court should begin to hear oral arguments on 18 March.

 http://www.supremecourtus.gov/oral_arguments/argument_calendars/MonthlyArgumentCalMarch2008.pdf

Bear in mind, the case will just decide the following:
Petition GRANTED limited to the following question: Whether the following provisions - D.C. Code §§ 7-2502.02(a)(4), 22-4504(a), and 7-2507.02 - violate the Second Amendment rights of individuals who are not affiliated with any state-regulated militia, but who wish to keep handguns and other firearms for private use in their homes?

I tried to answer your question by giving what info is available as to its current status.  The additional info is for voters who elected anti firearms Congressmen.  The shear number of amicus briefs filed in opposition to the individual right to own firearms is staggering compared to the quantity of those in support.  I thought it might be pertinent to firearms owners reading the post in answer to your question.  It is more than probable that some of GBO members are also supporters of these organizations which want to take away our firearms rights and they should know as being pertinent to your question.  No there has been no decision, but amicus briefs have been filed in opposition or support of the upcoming decision is relevant to its outcome.
