Snares in Georgia

Since I couldn't find any reference to the use of snares in the general game laws booklets, I called a Conservation Officer friend.  He said the weren't legal and sent me the code statute he used as the basis he his belief.  I read the cite, then the whole code section, then I read the entire section again.  I emailed the Ranger that the OCGA section he cited did NOT prohibit the use of snares and further it did not appear that there was any prohibition on their use during trapping season.  He's checking on it.  I asked another Ranger the same question this week while attending CLE seminars and got the same answer; snares are not permissible in GA.  He cited a code section that was different then the one cited by the first Ranger, But I showed him where and why I did not believe snares were prohibited.  He's checking on it.   ::)

Now this may have to go up for an opinion of the State Attorney General, but by the "Rules of Construction" used in drafting statutes, I maintain the use of snares, or any other device, is not prohibited by statute in Georgia.  Does anyone have any experience in this area?  Better yet, does anyone volunteer to be arrested so we can take this up (on appeal) as a test case?   ;D

snares are legal in Ga. in water and on land no more than 10 feet from the water.

I think I know what you're referring to Bugeye, but I believe that is just a restriction on the general use of snares, not the only time they can be used.  Cite the authority for your opinion and I'll review it in context with the whole statute.   :)

Funny, I thought they'd be more Georgia boys interested in trapping.  30-40 years ago it was a fair enterprise.   ???

I read those first thing.  However, they are just short paraphrasings of the individual statutes.  Thanks for taking time to answer though ;D

 AtlLaw, trappers numbers have declined a lot ,from 30 and 40 years ago. Young people do not spend the time in the outdoors that we did.
 Snaring laws are a hard one, every state is different and many times confusing.I make snares for customers in several different states, and it seems that no two states are the same.
