Your best bet, is to contact your conservation officer or game warden--before traps are even set.Find out the correct procedure for dealing with this type of situation.
You are from New York--and you are very limited to the size of body gripping traps you can use on land--I believe that you are limited to a 110(please correct me if I am wrong). So your odds of catching a non-target-furbearing animal during season are very limited.
When in doubt--set somewhere else, or use a foothold(which is a live trap).
