I gotta throw the BS flag on this whole issue!  Our kids are being held to different legal standards than we as adults are.  These kids can't vote, can't buy a car, can't drink, can't serve their country but they CAN be labelled a child sex offender for life for sending a nude or semi nude picture of their own body to someone who has most likely seen the real thing!!!  Bull Crap.  I have three teenagers.  Two girls and a boy.
I don't want any of them to "sext" anyone.  I don't advocate it in any way shape or form.  However, if my 16.5 year old daughters choose to do so, then that is no different than my wife sending one to me.  As long as the "partner" is not an adult I can't say that I would want any charges to be filed.  If this involves and adult and a minor then yes, I see an issue.  Especially if the adult instigates.  But then again... what if the girl next door decides she likes you and sends you a "sext" to get your attention.  You didn't do anything wrong.  You didn't start it.  You didn't ask for the pictures.  But hey... you are a child sex offender for life.  Lot's of different scenarios to think about.  I'd say that the legal system hasn't caught up with society and technology on this issue.  Still bullcrap for teens to send to teens and get arrested for it.  They screw each other and don't get arrested.  Why should they get arrested for pictures?  Now forwarding the pictures to other teens is another area to think about.  I don't think it is worth a life time sentence for sending picture to your BF or GF, or for receiving a picture from your BF or GF.  However, if you then forward that picture without their consent...

I had one in 6th grade.......but I paid for it myself. You would be suprised how many kids have phones younger than that. When i first got into sales and marketing i worked for sprint. There is one time i rember that i sold 2 $400 phones to a mother. These phones were for her 4 and 5 yr old. She also got them a completely unlimited plan. These were PDA's which are business organizers. I agree my kids(when i have them) wouldnt have a phone till they could pay for it.

I am glad things like this never happened when i was in high school (we didn't
have cel phones) we had to do it with a polaroid instamatic. some times we had to
 tie the girls up to make them be still for the pic. JUST JOKING they enjoyed it just as much as we did. Kids just don't care about what might happen tomorow.

I want to ask all you fathers with girls. What would you do to the boy friend?  I know the girl made a mistake but it was the boy that sent the pictures to the other classmates.  I do believe I would have done something really bad.  REAL BAD.

The boyfriend would be banned from the house till I decide different. Daughter takes a hide tanning and is banned to the house till I decide different.  I started dating my x-wife  when she was 13 and I was 15. We stayed together for the next 15 years. I think of some of the things we did in the 14-16 age range and it makes me shudder. Her dad was a front loader driver and worked 2am-2pm. I'm glad he was a sound sleeper, cause I would have BEAT THE *&^% out of me.  Of course, no young man will be allowed in MY house if I'm not up and awake....  There will also be NO closed doors and if I EVER find a locked door, the door comes off the hinges and goes into the basement until I decid different.

My daughter has a cell phone for saftey reasons only. We are only a phone call away that way. She does not abuse it and stays with in hers minutes allowed, wich is not many. Dale

I will say this. There are some ground breaking add-ons that you can get for a phone that makes me consider getting one for my daughter.  Verizon has a very reasonably priced phone that can only dial 1 of 4 preprogrammed #'s and can only get calls from those #'s. More importantly the imbedded GPS will send the "parent" phone a text when it leaves the preapproved areas. (Home, babysitter, school, etc...)  There have been several instances of kidnapped children being located by their cell phone's GPS or the kids making calls and getting help before it is too late.  This is all big-brother ish and the implications to an adult scare me, but my daughter will not have rights for another 12 years as far as I'm concerned.

Yea disney has a phone like that. phones like that i can inderstand. If they can only call mom, dad, grandma, ect.....  That would be very practical.

She can take pictures with her phone but for her to send text messages it costs extra in her plan and knows she is not allowed to to send text messages. She has had it a couple years now and has not broke the rules. I can even go to their web site and see the phone numbers she is calling. Dale
