Shootall:  Yea, the In-Laws hate the fact that the wife and I both carry.  They think we are violent people.  Their view is if someone breaks into your home, give them what they want and they will go away.  They are what I call Sheeple.

This will definetly push the limits. Even states that have no push to do anything like this, will keep a close eye on how this turns out. It will mean so much more soverign rights to the state.  gypsyman

Acts which would cause such a nullification include, but are not limited to:

II. Requiring involuntary servitude, or governmental service other than a draft during a declared war, or pursuant to, or as an alternative to, incarceration after due process of law.

IV. Surrendering any power delegated or not delegated to any corporation or foreign government.

VI. Further infringements on the right to keep and bear arms including prohibitions of type or quantity of arms or ammunition; and
That should any such act of Congress become law or Executive Order or Judicial Order be put into force, all powers previously delegated to the United States of America by the Constitution for the United States shall revert to the several States individually.

I think the people are getting the word, and are fearing what Obama might be trying in the not too distant future.  They are preparing for the event.  Like one of our legislatures said last week on the radio, in regards to things coming down from the Federal Government.  "We are preparing for the worst, and hoping for the best".  We are backing Gov. Palin, she won't back down, and she is cautious of the Feds.

That's the way the Feds have kept the states in line before, they cut funding.  Well Montana stood up to them and said cut the funding.  The Feds backed down.  Now Alaskans are wanting to get off the Federal funds kick.  Let them keep their money, we are not going to do certain things anymore.  We need to develop our resources and just ignore the Feds.

Now here is food for thought. How about when th Feds cut funding for a state, the governor of that state orders all businesses both public and private to send the taxes being withheld for federal income taxes to the state taxing athourity. Then the state can divey up the the money and fund what they see fit. Also they can take the surplus and return it to the taxpayers as a refund. The federal government does not have any money of its own, only the taxes collested from the citacens.
99% of all Lawyers give the other 1% a bad name. What I find hilarious about this is they are such an arrogant bunch, that they all think they are in the 1%.

Wouldn't be the first time that states pushed back against the Feds. Ohio did it back in the '70's with the helmet law. Feds said they would hold back highway funds if they didn't keep the helmet law into effect. Ohio came back with, we pay you more than we get back, so therefore, we will keep our highway funds, and not send any in. Well, no helmet law. States are going realize, they have more rights and power than they know about. It's just that the Feds like to blackmail and bamboozle, and make them think they have the power. gypsyman

You are very lucky to have a Gov. like Palin. She has a lot of grit, and thats what I like about her. On the other hand we have a, want to be dictator for govener here in PA. (Rendell)  Talk about a stark contrast between the two.  Its mostly the high populations in Philly and Pittsburgh that keep voting these comunists into office.

I don't have any idea how the SCOTUS will rule on the case.  Historically interstate commerce was very broad, I'm sure you knew that.  Starting with US v. Morrison the court started backing away from the most absurd claims. 

But Federal law already regulates suppressors, so that law could be calleneged and this new law would have nothing to do with it, assuming that Montana didn't have its own law against them.  Some Montana resident needs to build a silencer for in-state use, and get arrested by the Feds... 

Just because Montana says something is legal doesn't make it so.  California's pro-marijuana laws already have this problem.  The real question would be what level of enforcement the Feds would press, and what the SCOTUS would say.  I wouldn't hold my breath for a good result, but I certainly am not an expert in Con Law.

So FWIW and based on my often faulty recollection, remember what Roosevelt (FDR) said when the Supreme Court ruled against him on a constitutonal issue.  He said, "The Supreme Court has made it's decision, now let them enforce it!"  And he did what he wanted to.

Nixon, when ordered to turn over some tapes, did so when he could have pushed the executive privilage issue.  He turned them over because he wanted to avoid a Constitutional crisis.

I don't think this president is worried about a "Constitutional crisis" and will do whatever fits his agenda, riding over States Rights on the phantom "Commerce Clause" as has been done by the Feds for a long time.  Not that that's much effort since most believe the Federal Gov't is and should be supreme.  That being the arch Constitutional criminal A. Lincoln's legacy.

But, as I said, I really don't have an opinion...  ;D

The wording of the law being pushed through in Alaska says that when the Feds charge the first person the state attorney General is obligated and will take over and defend the state law to the fullest extent.  Rog

Good for Montana and Montanan's. More states should follow in the same foot steps. My ques is you will see states like Idaho, Wyoming, Texas amd Alaska follow.

Our federal government is trampling all over our rights. They are suppose to be the ultimate protector but their massive failures in this area will/should lead to more of this type of state laws.

I can't wait till the clowns over at MSNBC get a hold of this one. They will call the gov and Montanan's a bunch of right wing extremisits for passing a law that essentially threatens the feds. They will do this while they hail Mayor Newsome and the rest of the Mayors that violate federal law everyday with sanctuary city laws that protect illegals from deportation and even protect illegals wanted on federal murder charges. What a joke, but watch and see.
