I'm trying to save everyone the legal headache, I know how it goes. yes, fishy as it may seem, its really easy, there was supposed to be a trade but it never took place and he retained the firearm, so I refer to it as I "lent" it to him till he kept his end of the deal. I need the $ from the gun or the gun it's self to sell and pay bills. I've already sold most of my firearms.

hell, he even as a set of 45 acp dies, which I got in trade on here

all I've really got to say is that the gun would be the least of his issues if I went legal with it. I'm trying to be civil and nice, but I dont want to get screwed as well

Had tools stolen off several trucks , pawn shop bought tools chat did no good for me . I had invoices where i bought them and had tools marked with ID tags and ser. numbers listed .

Did you take an officer with you?
Proof on your own won't get it done.
You must have some sort of law with you when you go to claim.

possession of a stolen gun will  get  3 years  in  florida

only  way  out  is  destify where you got  it

Longtom , one example - Guy i had worked with before going in business was looking for used tools in a pawn shop . He saw my company tools , they were well marked . He called me , I went to store and saw tools . Went outside and called police on my cell phone . Waited 2 hours for cop , told him what was going on . He goes in with me and sees the tools . He ask where the shop got them and was told the bought them . He looks at me and says he needs to know when ( date and time ) they were stolen . He needed to know city or county they were stolen in as it might not be his jursidiction . The cop said there was nothing he could do other than fill out a report for our insurance . This has happened several other times .

Typically only way to make that stick is for the gun to have already been reported stolen - otherwise they have no way of knowing (I know pawn shops in this state are supposed to check against a database on any firearms they receive to ensure that it's not been reported stolen).

Best bet I'd say would be to forget about being amicable and the like and report it stolen and that you know who has it.  The shop won't be liable since they had no way of knowing, but they'll have to return it.

Everything else isn't going to help IMHO.  You can talk and talk till you're blue in the face but at the end of the day if they don't give it back there's not much you can do yourself.  Try to use physical force or threats and then you risk getting into serious legal trouble yourself.  Best to just let the authorities handle it.

Around home the cops in a situation like yours will place a hold on the items until they can do a little check see.
I admit it works better if a report was filed as soon as they are stolen.
I guess different locations/states handle things differently.

Longtom i reported as soon as i knew , at the time i had 47 trucks on the road and over 130 people working . These tools were taken by an employee and hocked for drugs . It all happened in about 10 days . He was out at 2am with company truck , got pulled , jailed , convicted of dui , drugs etc , went to jail for a couple years and i had to pay to get my truck out of impound . Found the tools missing and that same day the guy called about the tools being in the hock shop . Want to hear the BS part , some say the pawn shop is run by cops !
